Common use of Prior to Commencement of Work Clause in Contracts

Prior to Commencement of Work. 1. Tenant shall submit to the Building manager a request to perform the Alterations. The request shall include the following enclosures: (i) A list of Tenant's contractors and/or subcontractors for Landlord's approval. (ii) Three complete sets of plans and specifications properly stamped by a registered architect or professional engineer certifying compliance with applicable building codes. (iii) A properly executed building permit application form. (iv) Four executed copies of the Insurance Requirements agreement in the form set forth in Exhibit D from Tenant's contractor and if requested by Landlord, from the contractor's subcontractors. (v) Contractor's and subcontractor's insurance certificates including an indemnity in accordance with the Insurance Requirements agreement. 2. Landlord will return the following to Tenant: (i) Plans approved or returned with comments (Such approval or comments shall not constitute a waiver of Building Department approval or approval of other governmental agencies). (ii) Two fully executed copies of the Insurance Requirements agreement. 3. Tenant shall obtain a building permit from the building department and necessary permits from other governmental agencies. Tenant shall be responsible for keeping current all permits. Tenant shall submit copies of all approved plans and permits to Landlord and shall post the original building permit on the Premises prior to the commencement of any work. All Alterations shall be subject to reasonable supervision and inspection by Landlord's representative. Such supervision and inspection shall be at Tenant's sole expense and Tenant shall pay Landlord's reasonable charges for such supervision and inspection. Landlord shall notify Tenant if it estimates that the expense of supervision and inspection for any project shall exceed $1,000, if Tenant shall first request such estimate.

(ii) Two fully executed copies of the Insurance Requirements agreement. 3. Tenant shall obtain a building permit from the building department Building Department and necessary permits from other governmental agencies. (iii) A properly executed building permit application formform if required. (iv) Four executed copies of the Insurance Requirements agreement in the form set forth in attached to these Tenant's Work Requirements as Exhibit D IR from Tenant's contractor and if requested by Landlord, Landlord from the contractor's subcontractors. (v) Contractor's and subcontractor's insurance certificates including an indemnity in accordance with the Insurance Requirements agreement. In connection with Minor Alterations, Tenant shall provide Landlord with prior written notice of the nature and timing of such Minor Alterations as well as copies of plans and specifications, if any, concerning such modifications. 2. Landlord will return the following to Tenant: (i) Plans Two sets of plans approved or returned a disapproval with specific comments as to the reasons therefor (Such such approval or comments shall not constitute a waiver of Building Department approval or approval of other governmental agencies). (ii) Two fully executed copies of the Insurance Requirements agreement. 3. To the extent required to perform any Alterations, Tenant shall obtain a building permit from the building department and other necessary permits from other governmental agencies. Tenant shall be responsible for keeping current all permits. Tenant shall submit copies of all approved plans and permits to Landlord and shall post the original building permit on the Premises prior to the commencement of any work. All Alterations work, if performed by a contractor or subcontractor, shall be subject to reasonable supervision and inspection by Landlord's representative. Such supervision representative during normal business hours and inspection upon no less than twenty four (24) hours advance notice except in the case of emergencies for which no advance notice shall be at Tenant's sole expense and Tenant shall pay Landlord's reasonable charges for such supervision and inspection. Landlord shall notify Tenant if it estimates that the expense of supervision and inspection for any project shall exceed $1,000, if Tenant shall first request such estimaterequired.

Landlord will return the following to Tenant: (i1) Plans approved A letter of approval or returned disapproval with specific comments as to the reasons therefor (Such such approval or comments shall not constitute a waiver of Building Department approval or approval of other governmental agenciesauthorities). (ii2) Two fully executed copies of the Insurance Requirements agreementAgreement. 3. c. Landlord's approval of the plans, drawings, specifications or other submissions in respect of any Alterations shall create no liability or responsibility on the part of Landlord for their completeness, design sufficiency or compliance with requirements of any applicable laws, rules or regulations of any governmental or quasi-governmental agency, board or authority. d. Tenant shall obtain a building permit from the building department Building Department and necessary permits from other governmental agencies. Tenant shall be responsible for keeping current all permits. Tenant shall submit copies of all approved plans and permits to Landlord and shall post the original building permit on the Premises prior to the commencement of any work. All Alterations shall be subject to reasonable supervision and inspection by Landlord's representative. Such supervision and inspection shall be at Tenant's sole expense and Tenant shall pay Landlord's reasonable charges for such supervision and inspection. Landlord shall notify Tenant if it estimates that the expense of supervision and inspection for any project shall exceed $1,000, if Tenant shall first request such estimate.
