Common use of Private Enterprise Clause in Contracts

Private Enterprise. ‌ (a) Protections. The Recipient agrees to protect the interests of private enterprise affected by federal public transportation programs by: (1) Encouraging private enterprise to participate in the planning of public transportation and programs that provide public transportation, to the extent permitted under 49 U.S.C. § 5306; and (2) Providing just compensation for the Project property it acquires, including the franchises of private providers of public transportation, as required under 49 U.S.C. § 5323(a)(1)(C).
