Common use of Private Investors Clause in Contracts

Private Investors. On April 18, 2007 and pursuant to the Purchase Agreement, each Private Investor contributed to the Company cash in an amount equal to an amount set forth opposite its name on Schedule I to the Purchase Agreement in exchange for the number of Common Units set forth opposite its name on Schedule I to the Purchase Agreement. The cash received by the Company pursuant to the immediately preceding sentence was used to retire the Company’s obligation to make a $37.2 million cash payment to Nami in reimbursement for certain capital expenditures.
