Procedure for. taking possession- Upon the Promoter obtaining the completion certificate or the occupancy certificate, as the case may be, from the competent authority and upon the Sellers’ receiving all payments from the Allottee as per this Agreement, the Sellers shall offer in writing the possession of the Apartment, to the Allottee in terms of this Agreement, such possession to be taken by the Allottee within two (2) months from the date of issue of the completion certificate or the occupancy certificate, as the case may be. The Sellers agrees and undertakes to indemnify the Allottee in case of failure of fulfilment of any of the provisions, formalities, documentation on part of the Sellers. The Allottee shall take possession of the Apartment within 15 (fifteen) days of the written notice from the Sellers to the Allottee intimating that the said Apartment is ready for use and occupy (hereinafter referred to as the “Possession Date”). The Allottee, after taking possession, agrees to pay the maintenance charges as determined by the Promoter/ Sellers/Association, as the case may be after the issuance of the completion certificate for the Project, in accordance with the provisions of this Agreement. The Promoter shall hand over the occupancy certificate of the Apartment, if any, to the Allottee at the time of conveyance of the same.
