Procedures and Assurances. 1. The District will collect from employees who are not members of the Association a sum equivalent to the dues levied by the Association upon its members and remit that sum to the Association together with the dues deducted from the salaries of the employees who are members of the Association pursuant to section 1.3.
2. Deduction of the service fee provided for in subparagraph 2 of this paragraph shall be made beginning in September and ending in June of each school year. Deductions for employees who are hired after October 1 of any school year shall be appropriately prorated and shall be made in such manner as to complete deduction of the service fee by the end of that school year.
3. The Association warrants that it has established and will maintain a procedure for the refund to employees of the amount of its dues which are in aid of activities or causes of a political or ideological nature only incidentally related to collective bargaining and that such procedure complies in all respects with the provisions of Chapter 677 of the Laws of 1977 and the Constitution of the United States of America and the State of New York.
4. The Association will at all times hereafter indemnify and save harmless the District and its officers, agents and employees against any liability, loss, damage, cost or expense which may be incurred or sustained by any of them as a result of or in connection with any action or proceeding by which any person or entity asserts the invalidity of the Association's refund procedure or the impropriety of the deduction of agency or service fees from the salaries of the employees or the transmission of such fees to the Association. In the event any such action or proceeding is commenced against the District or any officer, agent or employee thereof, the District or such officer, agent or employee shall within a reasonable time give notice in writing to the Association. Upon the giving of such notice the Association shall, at its expense, defend any such action and take all necessary steps to prevent the entry of any judgment or order against the District or any officer, agent or employee thereof. In the event that any judgment is entered against the District or any of its officers, agents or employees, the Association shall pay such judgment together with the costs of complying with any interim order or final judgment which may be entered in such action or proceeding.
