Common use of Proceedings Upon Modification or Termination Clause in Contracts

Proceedings Upon Modification or Termination. If, upon a finding under Section 6.3, CITY determines to proceed with modification or termination of this Agreement, CITY shall give written notice to OWNER of its intention so to do. The notice shall be given at least ten (10) calendar days prior to the scheduled hearing and shall contain: (a) The time and place of the hearing; (b) A statement as to whether or not CITY proposes to terminate or to modify the Agreement; and, (c) Such other information that the CITY considers necessary to inform OWNER of the nature of the proceeding.

If, upon a finding under Section 6.36.1.6(b), the CITY determines to proceed with modification or termination of this Agreement, the CITY shall give written notice to the property OWNER of its intention so to do. The notice shall be given at least ten (10) calendar days prior to the scheduled hearing and shall contain: (a) The time and place of the hearing; (b) A statement as to whether or not the CITY proposes to terminate or to modify the this Agreement; and, (c) Such other Other information that the CITY considers necessary to inform the OWNER of the nature of the proceeding.

The notice shall be given at least ten (10) calendar days prior to the scheduled hearing and shall contain: (a) The time and place of the hearing; (b) A statement as to whether or not CITY proposes to terminate or to modify the Agreement; and, (c) Such other information that the CITY considers as is reasonably necessary to inform OWNER of the nature of the proceeding.

If, upon a finding under Section 6.35.3, CITY City determines to proceed with modification or termination of this Agreement, CITY City shall give written notice to OWNER Owner of its intention so to do. The notice shall be given at least ten (10) calendar days prior to the scheduled hearing and shall contain: (a) 5.4.1. The time and place of the hearing; (b) 5.4.2. A statement as to whether or not CITY City proposes to terminate or to modify the this Agreement; and, (c) 5.4.3. Such other information that the CITY City considers necessary to inform OWNER Owner of the nature of the proceeding.
