Common use of Proceeds Suspense Clause in Contracts

Proceeds Suspense. Except for Mortgagor’s interests in certain Oil and Gas Properties, which Mortgagor represents do not constitute a material portion (with 5% or more being deemed material) of the present value of the Collateral and all other Properties of Mortgagor securing the Obligations, all proceeds from the sale of Mortgagor’s interest in the Hydrocarbons from the Oil and Gas Properties are being received by Mortgagor in a timely manner and are not held in suspense for any reason.
