Level I. If the grievance is not resolved through informal discussions, the supervisor shall give a written decision on the grievance to the parties involved within ten (10) days after receipt of the written grievance.
Level I. 3.3.1 If an employee or the Association wishes to initiate a formal grievance, the employee or Association must do so within twenty five (25) workdays after the occurrence of the act or omission giving rise to the grievance by presenting such grievance in writing to the immediate administrator. If neither the grievant nor the Association had actual or constructive knowledge of the occurrence of the grievable act or omission, and could not with the exercise of reasonable diligence have known about it, then the twenty five (25) day time limit shall begin to run on the date upon which either the grievant or Association knew or could with reasonable diligence have known of the occurrence. 3.3.2 The written statement shall be a clear and concise statement of the grievance, including the specific provisions of the Agreement alleged to have been violated, misapplied or misinterpreted; the circumstances involved; and the specific remedy sought. The written statement described herein shall be submitted on a jointly-developed Grievance Form provided by the District, and said statement shall not be changed at later levels of the grievance and arbitration procedure, as described in this Article. 3.3.3 Either party may request a personal conference with the other party. The administration shall communicate a decision to the employee in writing within ten (10) workdays after receiving the grievance and such action will terminate Level I.
Level I. 19.4.1.1 Within twenty (20) days of the time an alleged grievance is said to have occurred, the grievant shall submit the grievance on the appropriate form (Appendix C attached) to the college president or designee. The employee shall have discussed the grievance informally with the College President or designee within the twenty (20) days.

Subd. 2. Level II. In the event the grievance is not resolved in Subd. 1 (Level I) above, the decision rendered may be appealed to the Superintendent, provided such appeal is made in writing within 5 days after receipt of the decision in Subd. 1 (Level I) above. If a grievance is properly appealed to the Superintendent, the Superintendent or his/her designee shall set a time to meet regarding the grievance within 15 days after receipt of the appeal. Within 10 days after the meeting, the Superintendent or his/her designee shall issue a decision in writing to the parties involved. Subd. 3. Level III. In the event the grievance is not resolved in Subd. 2 (Level II) above, the decision rendered may be appealed to the School Board, provided such appeal is made in writing within 5 days after receipt of the decision in Subd. 2 (Level II) above. If a grievance is properly appealed to the School Board, the School Board shall set a time to hear the grievance within 20 days after receipt of the appeal. Within 20 days after the meeting, the School Board shall issue its decision in writing to the parties involved. At the option of the School Board, a committee or representative(s) of the School Board may be designated by the School Board to hear the appeal at this level and report the findings and recommendations to the School Board. The School Board shall then render its decision.

Following this meeting the Executive Director shall have five (5) days to provide a written decision on the grievance to the parties involved.

The immediate management supervisor shall communicate a decision to the grievant in writing within twenty (20) days after receiving the grievance and such action will terminate Level I.

Level I. 11.3.1.1 Within 30 days after the occurrence of the acts or events giving rise to the grievance, the grievant must present the grievance in writing on the form mutually agreed upon by CSEA and the District to the grievant’s immediate supervisor. However, the grievant shall be encouraged to discuss the issues informally with the appropriate District official before actually filing the grievance. The District will extend the time limit for filing the grievance if there is a reasonable probability the grievance can be resolved informally. 11.3.1.2 This statement shall be a clear, concise statement of the grievance, with the specific section of the collective bargaining agreement allegedly violated, the circumstances involved, the decision rendered at the informal conference, and the specific remedy sought. 11.3.1.3 Within 10 days after receipt of the written grievance, the immediate supervisor shall meet with the grievant in an effort to resolve it. Within 10 days thereafter, the supervisor shall communicate the decision in writing to the grievant.
Level I. 12.2.1.1 Within fifteen (15) working days of the time an employee knew or should have known of the occurrence of an alleged grievance, the Unit Member shall discuss with the immediate supervisor the alleged grievance. 12.2.1.2 If a satisfactory resolution is not reached within two (2) days of the discussion, the grievant shall present, within three (3) days thereafter, on the grievance form, attached hereto as Appendix B, the grievance in writing to the next higher designated administrator or designee. 12.2.1.3 The next higher administrator or designee shall communicate the decision to the Unit Member in writing within seven (7) days after receiving the grievance. The grievant, next higher administrator or designee may request a personal conference within the above time limits.

If the supervisor does not respond within the time limits, the grievant may appeal to the next level. Within the above time limits, either party may request a personal conference with the other party.
