Pseudonymized identifiers may be included in Diagnostic Data or Service Generated Data and are also Personal Data. Any Personal Data pseudonymized, or de-identified but not anonymized, or Personal Data derived from other data is also Personal Data. To the extent Sales Cookie is a processor or sub processor of Personal Data subject to the GDPR, the GDPR Terms govern that processing and the parties also agree to the following terms in this sub-section (“Processing of Personal Data; GDPR”):

Any Personal Data pseudonymized, or de-identified but not anonymized, or Personal Data derived from Personal Data is also Personal Data. To the extent Microsoft is a processor or subprocessor of Personal Data subject to the GDPR, the GDPR Terms in Attachment 2 govern that processing and the parties also agree to the following terms in this sub-section (“Processing of Personal Data; GDPR”):

Pseudonymized identifiers may be included in Diagnostic Data or Service Generated Data and are also Personal Data. Any Personal Data pseudonymized, or de-identified but not anonymized, or Personal Data derived from Personal Data is also Personal Data. To the extent GitHub is a processor or subprocessor of Personal Data subject to the GDPR, the GDPR Related Terms in Attachment 3 govern that processing and the parties also agree to the following terms in this sub-section (“Processing of Personal Data; GDPR”):

Processing of Personal Data; GDPR. The Standard Contractual Clauses govern that processing and the parties also agree to the following terms in this subsection (“Processing of Personal Data; GDPR”):
a. Processor and Controller Roles and Responsibilities. Customer and Publisher agree that the Publisher is a data processor of Personal Data limited to the contact information collected at the point the Customer purchases an Offering. This is detailed in the Offerings privacy statement. However, the Publisher is neither a data processor or controller for any data processed by the Customer via the Offerings.
Processing of Personal Data; GDPR. The subparagraph entitled “Processing Details” in the paragraph entitled “Processing of Personal Data; GDPR” in the “Data Protection Terms” section of the OST is replaced in its entirety with the following: “Processing Details The Microsoft entity signing this CTM Amendment 2 will cause Microsoft Corporation to replace the paragraphs “Data subjects” and “Categories of data” in Annex 1 to Attachment 3 – The Standard Contractual Clauses (Processors) of the OST in their entirety with Annex 1 as attached hereto. For the avoidance of doubt, individual Affiliates are not required to provide their input to Microsoft with regards to Annex 1 to Attachment 3, but if required can maintain a completed version of Annex 1 to Attachment 3 in their administration.
