Product Specification. Production specifications - Suppliers with development responsibility shall implement the customer’s requirements in all necessary product descriptions (such as functional specification, drawings, internal standards, …). However, production-related dimensions that are not described in 3D data models (e.g. connection points, form dividing seams) must generally be determined and specified. To avoid processing and conflict problems, they must be coordinated with the responsible voestalpine person who coordinates development at voestalpine. The supplier shall prepare a process flow chart for the entire process chain. At voestalpine’s request, this process flow chart shall be presented before the start of series production for joint discussion. The process flow chart must be consistent with the process FMEA and the production control plan.
Product Specification. Licensee shall provide to PalmSource a written, detailed product specification for each Licensee Product released by Licensee after the Original Execution Date, prior to receiving any development support and training services (as described in Section 8 (Support and Training) below) to facilitate development support. Subject to the exceptions set forth in Section 13.2 (Exceptions to Confidential Information) below, such specification shall be deemed Confidential Information of Licensee for purposes of this Agreement, regardless of whether or not it is so marked. Licensee shall use its reasonable commercial efforts to xxxx such materials as confidential.
Product Specification. The functions of the Software and a description of any Services are set forth and described in the product description available on the TeamViewer website and on the applicable Order (“Product Specification”). Only this Product Specification shall be relevant to the contractually agreed quality and features of the Software and the Services; any other oral or written statements of TeamViewer shall not be relevant. Some features and functions of the Software or Services provided by TeamViewer may include or depend on certain third-party products and services all of which may be subject to changes by such third parties. Accordingly, such features and functions may be modified or limited by TeamViewer.
Product Specification. The Product must be manufactured, packaged, labeled, and handled according to the Specifications and procedures mutually agreed to in writing between Customer and BVL. Customer and BVL shall develop all in-process and Product release specifications, including acceptance limits for each required test. Establishment of appropriate test methods and supporting test method validation will be performed by BVL and approved by Customer. Each lot of Product manufactured by BVL for Customer will be sampled and tested in accordance with the Specification.
Product Specification. XXXX represents and warrants that all the Biodiesel delivered to MBF will comply, at the time of delivery at the Biodiesel Delivery Point, with the Standard EN 14214 in force at the time of delivery subject to the following additions and amendments : water maximum of 350ppm, Monoglycerides 0.5 mass % Max, CFPP maximum of 12 degrees Celsius for TME and CFPP maximum of minus 3 degrees Celsius, iodine maximum 135 and cetane minimum 47 for SME, FOB specification. No additives will be combined with or added to the Biodiesel unless requested by MBF. If MBF requests that no oxidative stabilizer be added, the oxidative stability requirements of the EN14214 and ASTM D6751 specifications in force at time of delivery will be waived, provided however that XXXX shall make reasonable best efforts to meet the EN14214 and ASTM D6751 oxidative stability requirements to the extent possible without the addition of any additives. XXXX also represents and warrants that all Biodiesel delivered to MBF will comply, at the time of delivery at the Biodiesel Delivery Point, with the ASTM biodiesel standards in force at the time of delivery (with the exception of oxidative stability if MBF request that no oxidative stabilizer be added). If MBF requests the addition of oxidative stabilizer to the Biodiesel, XXXX will add such oxidative stabilizer at XXXX’x expense, and in the case of oxidative stabilizer being added Biodiesel will meet EN14214 specifications for oxidative stability. Should MBF request the use of an oxidative stabilizer not normally used by REG, MBF will bear the cost of said oxidative stabilizer.
Product Specification. 4.1 Sufficient B-type or wide pore spherical synthetic amorphous silica (silicon dioxide, Si02) in accordance with US Military Specifications for desiccant materials, which details requirements for bagged, chemically inert and dehydrating agents (Desiccant Materials-MIL-D-3464). Each 100 or 500-capsule container may include 1-3 desiccant packs of desiccant to achieve best humidity absorption results.
Product Specification. Licensee shall promptly provide Palm with a written detailed specification or product plan for each Licensee Product.
Product Specification. The Product Specifications are regulated in the Quality Agreement and its relevant Annexes. A copy of the Product Specifications as of the Product Schedule Effective Date is attached hereto as Exhibit A. FRESENIUS shall provide COMPANY with a copy of any revised Product Specifications.
Product Specification. (1) The parties acknowledge that they may adjust the API Specifications during the course of the Analytical Phase and the Pilot Phase. Unigene, in consultation with Sandoz, will reasonably establish the final API Specifications (taking into account the information relating to the API learned during the Analytical Phase and the Pilot Phase) prior to submission of the first application for Regulatory Approval. Until the final API Specifications are so established, the draft API Specifications, as amended from time to time by agreement of the parties, shall apply for the purposes of the obligations set out in this Agreement.
(2) Once the API Specifications are fixed by agreement of the parties for submission of the first application for Regulatory Approval, the API Specifications may be amended from time to time (a) as dictated by the FDA and applicable laws or (b) by Unigene, provided that the Unigene amended API Specifications are reasonable in light of Sandoz’s technical capabilities and capacity. Unigene shall be responsible for the cost of validation after such amendment and any increases in cost of Manufacturing the API as a result of such amendment.
Product Specification. 6.1 If [the provisions of an Order so require] OR [an Order does not include a Product Specification] OR [[specify circumstances]], the Customer shall supply to the Manufacturer a Product Specification for the Products to be manufactured under that Order[, together with all other documents, cooperation and information reasonably requested by the Manufacturer to enable the Manufacturer to fulfil its obligations under this Agreement]. The Customer must fulfil its obligations under this Clause 6.1 [promptly following the agreement of that Order, unless the parties have agreed otherwise in writing].
6.2 The Customer warrants to the Manufacturer that:
(a) each Product Specification will be prepared with reasonable skill and care;
(b) each Product Specification will contain [all the information reasonably necessary] to enable [a competent manufacturer with expertise in the relevant field] to manufacture the relevant Products; and
(c) [all information provided by the Customer to the Manufacturer under or in connection with this Agreement will be accurate in all material respects].
6.3 The Customer warrants to the Manufacturer that neither the Product Specifications nor the designs for the Products supplied by the Customer to the Manufacturer will infringe any third party's Intellectual Property Rights[ or other legal rights] ([in any jurisdiction and under any applicable law]).
