Common use of Profits Clause in Contracts

Profits. Except as provided in the Regulatory Allocations Exhibit, Profits shall be allocated as follows: (a) First, to the Members who have been allocated Losses pursuant to Subsection 6.3(c) below until the cumulative Profits allocated pursuant to this Subsection 6.2(a) equal the cumulative prior allocations of Losses under that Subsection. (b) Next, to the Members who have been allocated Losses pursuant to Subsection 6.3(b) below until the cumulative Profits allocated pursuant to this Subsection 6.2(b) equal the cumulative prior allocations of Losses under that Subsection. (c) All remaining Profits shall be allocated to the Members in accordance with their percentage Membership Interests.

Profits. Except as provided in the Regulatory Allocations ExhibitExhibit (Exhibit D) and subject to Section 6.6, Profits shall be allocated as follows: (a) First, to the Members who have been allocated Losses pursuant to Subsection 6.3(c6.3(a) below until the cumulative Profits allocated pursuant to this Subsection 6.2(a) equal the cumulative prior allocations of Losses under that Subsection. (b) Next, to the Members who have been allocated Losses pursuant to Subsection 6.3(b) below until the cumulative Profits allocated pursuant to this Subsection 6.2(b) equal the cumulative prior allocations of Losses under that Subsection. (c) All remaining Profits shall be allocated to the Members in accordance with their percentage Membership Interests.

Except as provided in the Regulatory Allocations ExhibitExhibit (Exhibit E), Profits shall be allocated as follows: (a) First, to the Members who have been allocated Losses pursuant to Subsection 6.3(c5.3(a) below until the cumulative Profits allocated pursuant to this Subsection 6.2(a5.2(a) equal the cumulative prior allocations of Losses under that Subsection. (b) Next, to the Members who have been allocated Losses pursuant to Subsection 6.3(b5.3(b) below until the cumulative Profits allocated pursuant to this Subsection 6.2(b5.2(b) equal the cumulative prior allocations of Losses under that Subsection. (c) All remaining Profits shall be allocated to the Members in accordance with their percentage Membership Interests.

Except as provided in the Regulatory Allocations ExhibitSchedule B, Profits shall be allocated as follows: (a) First, to the Members who have been allocated Losses pursuant to Subsection 6.3(c6.3(b) below until the cumulative Profits allocated pursuant to this Subsection 6.2(a) equal the cumulative prior allocations of Losses under that Subsection. (b) Next, to the Members who have been allocated Losses pursuant to Subsection 6.3(b6.3(a) below until the cumulative Profits allocated pursuant to this Subsection 6.2(b) equal the cumulative prior allocations of Losses under that Subsection. (c) All remaining Profits shall be allocated to the Members in accordance with their percentage Membership Interests.

(c) All remaining Profits shall be allocated to the Members in accordance with their percentage Membership Interests.

(b) Next, to the Members Partners who have been allocated Losses pursuant to Subsection 6.3(b) below until the cumulative Profits allocated pursuant to this Subsection 6.2(b) equal the cumulative prior allocations of Losses under that Subsection. (c) All remaining Profits shall be allocated to the Members Partners in accordance with their percentage Membership Partnership Interests.

Except as provided in the Regulatory Allocations ExhibitExhibit (Exhibit E) and subject to Section 5.6, Profits shall be allocated as follows: (a) First, to the Members who have been allocated Losses pursuant to Subsection 6.3(c5.3(a) below until the cumulative Profits allocated pursuant to this Subsection 6.2(a5.2(a) equal the cumulative prior allocations of Losses under that Subsection. (b) Next, to the Members who have been allocated Losses pursuant to Subsection 6.3(b5.3(b) below until the cumulative Profits allocated pursuant to this Subsection 6.2(b5.2(b) equal the cumulative prior allocations of Losses under that Subsection. (c) All remaining Profits shall be allocated to the Members in accordance with their percentage Membership Interests.

(b) Next, to the Members who have been allocated Losses pursuant to Subsection 6.3(b4.2(b) below until the cumulative Profits allocated pursuant to this Subsection 6.2(b4.1(b) equal the cumulative prior allocations of Losses under that Subsection. (c) All remaining Profits shall be allocated to the Members in accordance with their percentage Membership Percentage Interests.

Profits. Except as provided in the Regulatory Allocations ExhibitExhibit (Exhibit H) and subject to Section 6.6, Profits shall be allocated as follows: (a) First, to the Members who have been allocated Losses pursuant to Subsection 6.3(c6.3(b) below in proportion to such Losses until the cumulative Profits allocated pursuant to this Subsection 6.2(a) equal the cumulative prior allocations of Losses under that Subsection.; (b) Next, to the Members who have been allocated Losses pursuant to Subsection 6.3(b6.3(a) below in proportion to such Losses until the cumulative Profits allocated pursuant to this Subsection 6.2(b) equal the cumulative prior allocations of Losses under that Subsection.; (c) All remaining Profits shall be allocated to the Members in accordance with their percentage Membership Interests. For these purposes, only Losses for periods beginning on or after the Effective Date shall be considered.
