Program Terms. The Executive shall be entitled to continued access to health benefits under, at the Executive’s election, the Company’s Blue Cross Blue Shield PPO Policy or BlueChoice Policy (the “Policies”), following the Executive’s retirement from the Company, for so long as (A) the Company continues to offer such Policy and (B) the Policy allows for such continued access; and, to the extent the Company no longer maintains at least one of the Policies, or access is no longer allowed under either of the Policies, the Company shall allow the Executive continued access to health benefits under a successor policy, or otherwise, for so long as it offers health benefits to its employees. Program Terms. You and your child have signed up for our In-Home Program. In this program, your child’s BrainyAct experience will be in your home. General program terms are found below. Specific details on the In-Home Program, including pricing and Equipment Usage Guidelines, can be found in Exhibit A, BrainyAct Programs & Terms. Attached as Exhibit B are Terms of Use for our website and software. Our Privacy Policy is attached as Exhibit C. You acknowledge that this Membership Agreement, including the attachments, constitutes the entire agreement between the parties related to your participation in the In-Home Program. The Membership Agreement cannot be amended except in written form executed by both parties. If any part of this contract shall be held invalid, that part shall be deemed excluded from this contract and the remainder of the contract shall remain in full force and effect. Your subscription to BrainyAct is not negotiable, transferable or cancelable except as otherwise provided herein.
Program Terms. Software subscriptions and certain Software consumption models may be subject to specific program terms identified at xxxxx://xxx.x0.xxx/pdf/customer-support/program-terms.pdf or in another written agreement between you and F5 (collectively, the “Program Terms”). The Program Terms incorporate and are governed by this License. In the event of a conflict between this License and the Program Terms, the Program Terms will control and govern with respect to the applicable Software.
Program Terms. Bank’s pricing schedule and certain other loan terms and conditions (collectively, “Program Terms”) are set forth on Exhibit A and shall apply to all Loans.
Program Terms. The details of an Advertiser’s Program shall be available through the Network Service. Transactions qualifying for a Payout are defined by the Advertiser. Advertisers may change any Payout rate upon no less than 7 days written notice through the Network Service with effect from the 8th day (or such later date as specified by Advertiser).

We do not offer any promises or guarantees with regard to our Program or Program Materials. You hereby acknowledge and agree:
A) You are solely and exclusively responsible for the interpretation and choices that you make with regard to this Program, the Materials contained within it, or any significant changes to your business or life;
B) You are solely and exclusively responsible for your own mental health, physical health, business decisions, and any other actions or inaction you choose to take;
C) We are not liable for any result or non-result or any consequences which may come about due to your participation in the Program;
D) This Program does not constitute a therapeutic relationship or a medical one. We do not provide therapy or medical services and you are responsible for procuring these services at your own will and discretion if needed.
E) This Program does NOT guarantee a specific cost expectation regarding purchaser’s expenses, including Program Fees and lead expenses. It shall be understood that each purchaser is responsible for diligently pursuing all ex-clients, including any attempts to contact, marketing, and/or monitoring. We are not responsible for any marketing content produced by the purchaser. We are in no way responsible for the quality exhibited by purchasers. In other words, we are not responsible for poor results if purchaser fails to produce desired results. This Program merely instructs purchasers on how to enhance his/her existing operations; the quality and performance of participants efforts are the responsibility of the purchaser.
F) Access to program includes, but is not limited to, the live Seminar, the lead data, access to the Program materials, and privilege to build referral opportunities. The Program Provider’s experts or affiliates may participate in discussions, but we are in no way obligated to future expectations of the purchaser as part of the purchase. Program Terms. EH will use commercially reasonable efforts to rent Owner’s reservation, consistent with EH’s policies and procedures, and subject to the terms of this Agreement. EH will utilize numerous marketing outlets to obtain the highest rental rate possible based on season, unit type and other competitive factors. Owner understands and agrees that all marketing efforts shall be directed towards the Program and nothing herein contained is intended to limit or restrict EH’s ability to rent other reservation participating in the Program. EH shall, in its discretion, rent any vacation reservation placed in the Program on any length of stay basis, whether daily, weekly or otherwise, subject to the maximum available term of said reservation. Owner understands and agrees that EH shall have no liability whatsoever hereunder for any reservation (or part thereof) not rented. EH reserves the right to accept or decline bookings and to establish rates and conditions for the Program, and Owner acknowledges and agrees that EH’s decisions regarding the Program shall be final and in EH’s sole and absolute discretion.
