Prohibition on Sale of PHI. Business Associate shall not sell or receive any remuneration, direct or indirect, of any kind in exchange for PHI or in exchange for the disclosure of PHI to any public or private agency or entity, except as expressly permitted by this Agreement or by the Services Agreement or by written authorization of BUSINESS ASSOCIATE.

Prohibition on Sale of PHI. Business Associate shall not directly or indirectly receive remuneration in exchange for any PHI of an individual unless the Covered Entity obtains from the individual a valid authorization that includes a specification of whether the PHI can be exchanged for remuneration by the entity receiving PHI of that individual.

If the Contract so allows, CONTRACTOR shall not, directly or indirectly, receive any remuneration in exchange for PHI, unless KDHE first obtains a valid authorization from the Individual that includes, but is not limited to, a specification of whether the PHI can be further exchanged for remuneration by the entity receiving the PHI of the Individual. This prohibition does not apply if the purpose of the exchange is for: (i) public health activities; (ii) research; (iii) treatment of the Individual; (iv) health care operations; (v) remuneration that is provided by KDHE to CONTRACTOR for activities involving the exchange of PHI that CONTRACTOR undertakes on behalf of and at the specific request of KDHE pursuant to the Contract; (vi) to provide an Individual with a copy of the Individual’s PHI pursuant to 45 CFR § 164.524; or (vii) as otherwise determined by the Secretary in regulations to be similarly necessary and appropriate as the above cited exceptions.
