Common use of Prohibition on Sub-Contracting Clause in Contracts

Prohibition on Sub-Contracting. 4.1 Subject to clause 3 of this Appendix the Enterprise will not subcontract the performance of any work which, but for the sub-contract, would be work which would be covered by this Agreement if performed by an Employee (“the work”). 4.2 Where an Enterprise breaches this clause by sub-contracting the work, and the sub-contractor provides terms and conditions of employment to its employees or contractors that are inferior to those contained in this Agreement, the Enterprise will, upon written demand of the Union, pay to those employees or contractors the sum representing the differ ence between the remuneration received by those employees or contractors and the remuneration which they would have received under this Agreement if it applied to them.
