Common use of Prohibition on Sub-Contracting Clause in Contracts

Prohibition on Sub-Contracting. (a) Subject to sub-clause 7.3.3 the Company will not subcontract the performance of any work which, but for the sub-contract, would be work which would be covered by this Agreement if performed by an employee (“the work”). (b) Preference wherever possible will be given to the use of sub-contractors that have a current Enterprise Agreement with the ETU.
