Prohibition on Sub-Contracting. A6.4.1 The Employer shall not, other than in accordance with this Part, subcontract the performance of any work which, but for the sub-contract, would be work that would be covered by this Agreement if performed by an Employee (“the work”). A6.4.2 Where an Employer breaches this clause by sub-contracting the work, and the sub- contractor provides terms and conditions of employment to its employees or contractors that are inferior to those contained in this Agreement, the Employer shall, upon written demand of the Union, pay to those employees or contractors the sum representing the difference between the remuneration received by those employees or contractors and the remuneration which they would have received under this Agreement if it applied to them..
