Project Audit. The Commission will perform a final audit of project costs. The United States Government shall reimburse the City, through the Commission, any monies due. The City shall refund any overpayments as determined by the final audit.

Project Audit. DASNY shall, upon reasonable notice, have the right to conduct, or cause to be conducted, one or more audits, including field inspections, of the Grantee to assure that the Grantee is in compliance with this Agreement. This right to audit shall continue for six (6) years following the completion of the Project or earlier termination of this Agreement.

Project Audit. The City may conduct an audit of any activities performed by Grantee pursuant to this Agreement. The City, or its designee, may perform such an audit for three (3) years after Closing or longer if otherwise required by law.

The Borrower shall cause MOT, ARD and the PMU to maintain separate project records and accounts adequate to identify the Works, Goods, and Consulting Services financed from the Loan proceeds, financing resources received, expenditures incurred for the Project, and use of counterpart funds. These project accounts and related financial statements will be audited annually in accordance with sound auditing standards by an independent auditor acceptable to ADB. The Borrower shall cause ARD to submit annual audited reports and related financial statements to ADB within six months after the end of each fiscal year during implementation of the Project. The audit of the imprest account and statement of expenditure will be carried out as part of the regular annual audit. The auditor’s opinion of the examination of the imprest account and statement of expenditure should be separately set out in the auditor’s report.
