PROPRIETARY INFORMATION/TRADE SECRETS. a. A bidder is responsible for identifying those portions of its bid that it deems to be confidential, proprietary information or trade secrets and must provide justification why such materials should not be disclosed by the City. A bidder is responsible for indicating all materials that the bidder desires to remain confidential by stamping the pages on which such information appears, at the top and bottom thereof with the word "Confidential". Such materials stamped "Confidential" must be easily separable from the non-confidential portions of the bid. b. All materials indicated as “Confidential” will be reviewed by the Department, and the Department will communicate to the bidder, in writing, any decision not to honor a request for confidentiality. For those bids which are unsuccessful, all confidential materials will be returned to the bidder. Prices, makes and model or catalog numbers of the items offered, deliveries, and terms of payment will be publicly available after bid opening regardless of any designation of confidentiality made by the bidder.
