PROTECTED PRESERVED CONDITIONS. (i) This Agreement is intended to be read in conjunction with Protected Preserved Conditions referred to in the Workplace Relations Act 1996 (the Act), as well as the Australian Fair Pay and Conditions Standard, as contained in the Act. A Protected Preserved Condition means a term of a preserved State agreement, derived from a State agreement, State Award or a provision of a State industrial law as in force at 26 March 2006 and prescribed in clause 25A of Schedule 8 of the Act. (ii) In addition and subject to the conditions contained in this Agreement, all employees are entitled to the following Protected Preserved Conditions: (a) Shift work loadings (b) Overtime loadings (c) Monetary Allowances for: 1. Expenses incurred in the course of employment; or 2. Responsibilities or skills that are not taken into account in the rates of pay; or 3. Disabilities associated with the performance of particular tasks or work in particular conditions or locations. (d) Observance of days declared as Public Holidays in New South Wales, for New South Wales or a region of New South Wales, and entitlements of employees to payment in respect of those days (e) Days to be substituted for or a procedure for substituting, Public Holidays referred to in sub clause (d) (f) Penalty rates (g) Annual leave loadings (h) Rest breaks This Agreement excludes any Protected Preserved Conditions not included in clause 4.2(ii) (other than outworker conditions).
