Common use of Protection of Software and DSS Software Clause in Contracts

Protection of Software and DSS Software. Except for those rights in the Ground Control Software and the SCIP Software specifically granted to Customer in this Contract, no other rights in such Software are granted to Customer. The Software and DSS Software and any associated documentation are trade secrets of Boeing and/or its licensor(s). Customer agrees to protect such Software and DSS Software and related documentation as Boeing’s Proprietary Information, subject to the provisions of Article 23 (Proprietary Information). Customer agrees to take all reasonable steps to safeguard from theft, loss and negligent disclosure to others all delivered Software and DSS Software. Customer shall take appropriate action by instruction and agreement with its employees and consultants who are permitted access to the Software and DSS Software, including advising such employees, consultants and satellite operators of these obligations.
