Provision of ELMS Data. (a) The User must provide ELMS Data for each Demand Customer Delivery Point. (b) If the User is required to provide ELMS Data for a Delivery Point and has not done so, ActewAGL may (acting reasonably) determine a Load Type or Load Types for that Delivery Point or any Quantity of Gas at that Delivery Point. (c) The User may request a copy of its ELMS Data for the Delivery Points under this Agreement at any time. Any such request must be in writing. (d) Subject to ActewAGL’s obligations to keep ELMS Data confidential, ActewAGL must provide the User with a copy of ELMS Data it has in respect of the User’s Delivery Points (or if it does not have ELMS Data for those Delivery Points, notify the User accordingly) within a reasonable time of receiving the User's request pursuant to clause 23.6(c). If ELMS Data is confidential to a third party (including another Network User) and ActewAGL is not able to confirm that it has written consent to disclose that ELMS Data, ActewAGL is not obliged to disclose that ELMS Data to the User, but must notify the User that it is unable to disclose that information. (e) The User may ask ActewAGL to update the ELMS Data for Delivery Points under this Agreement at any time. ActewAGL is obliged to make such a change only if the User provides evidence to ActewAGL's reasonable satisfaction justifying any changes requested. (f) ActewAGL may ask the User to: (i) confirm and/or update the ELMS Data for that User’s Delivery Points at any time; and (ii) provide evidence to ActewAGL's reasonable satisfaction justifying the ELMS Data provided. (g) The User must comply with a request from ActewAGL pursuant to clause 23.6(f) within 20 Business Days of receiving that request. (h) The User warrants that all ELMS Data it provides to ActewAGL is accurate and complete. The User must advise ActewAGL as soon as practicable after becoming aware that any ELMS Data it has provided to ActewAGL is no longer accurate or complete. (i) If, in the course of implementing Load Shedding, or a simulation of Load Shedding, ActewAGL determines that contact information contained in the ELMS Data for a Delivery Point is inaccurate, ActewAGL may update the ELMS Data for that Delivery Point in accordance with information provided by a Customer. ActewAGL may (but is not obliged to) request the User to confirm that ELMS Data in accordance with clause 23.6(f). (j) The User acknowledges that where the Tariff Class for a Delivery Point has in part been determined according to its Load Type. If the User: (i) fails to comply with its obligations under clause 23.6(g); or (ii) ActewAGL reasonably believes that ELMS Data provided by the User is incomplete or inaccurate, ActewAGL may alter the Tariff Class assigned to a Delivery Point, in accordance with the Access Arrangement.

(i) confirm and/or update the ELMS Data for that the User’s Delivery Points at any time; and
(ii) provide evidence to ActewAGLEvoenergy's reasonable satisfaction justifying the ELMS Data provided.
(g) The User must comply with a request from ActewAGL Evoenergy pursuant to clause 23.6(f) within 20 Business Days of receiving that request.
(h) The User warrants that all ELMS Data it provides to ActewAGL Evoenergy is accurate and complete. The User must advise ActewAGL Evoenergy as soon as practicable after becoming aware that any ELMS Data it has provided to ActewAGL Evoenergy is no longer accurate or complete, and must provide updated information accordingly.
(i) If, in the course of implementing Load Shedding, or a simulation of Load Shedding, ActewAGL Evoenergy determines that contact information contained in the ELMS Data for a Delivery Point is inaccurate, ActewAGL Evoenergy may update the ELMS Data for that Delivery Point in accordance with information provided by a Customer. ActewAGL Evoenergy may (but is not obliged to) request the User to confirm that ELMS Data in accordance with clause 23.6(f).
(j) The User acknowledges that where the Tariff Class for a Delivery Point has in part been determined according to its Load Type. If the User:
(i) fails to comply with its obligations under clause 23.6(g); or
(ii) ActewAGL Evoenergy reasonably believes that ELMS Data provided by the User is incomplete or inaccurate, ActewAGL Evoenergy may alter the Tariff Class assigned to a Delivery Point, in accordance with the Access Arrangement.

The User must advise ActewAGL the Service Provider as soon as practicable after becoming aware that any ELMS Data it has provided to ActewAGL the Service Provider is no longer accurate or complete.
(i) If, in the course of implementing Load Shedding, or a simulation of Load Shedding, ActewAGL the Service Provider determines that contact information contained in the ELMS Data for a Delivery Point is inaccurate, ActewAGL the Service Provider may update the ELMS Data for that Delivery Point in accordance with information provided by a Customer. ActewAGL The Service Provider may (but is not obliged to) request the User to confirm that ELMS Data in accordance with clause 23.6(f).
(j) The User acknowledges that where the Tariff Class for a Delivery Point has in part been determined according to its Load Type. If the User:
(i) fails to comply with its obligations under clause 23.6(g); or

The User must advise ActewAGL the Service Provider as soon as practicable after becoming aware that any ELMS Data it has provided to ActewAGL the Service Provider is no longer accurate or complete.

(h) The User warrants that all ELMS Data it provides to ActewAGL JGN is accurate and complete. The User must advise ActewAGL JGN as soon as practicable after becoming aware that any ELMS Data it has provided to ActewAGL JGN is no longer accurate or complete, and must provide updated information accordingly.
(i) If, in the course of implementing Load Shedding, or a simulation of Load Shedding, ActewAGL JGN determines that contact information contained in the ELMS Data for a Delivery Point is inaccurate, ActewAGL JGN may update the ELMS Data for that Delivery Point in accordance with information provided by a Customer. ActewAGL JGN may (but is not obliged to) request the User to confirm that ELMS Data in accordance with clause 23.6(f21.6(f).
(j) The User acknowledges that where the Tariff Class for a Delivery Point has in part been determined according to its Load Type. If the User:
(i) fails to comply with its obligations under clause 23.6(g21.6(g); or
(ii) ActewAGL JGN reasonably believes that ELMS Data provided by the User is incomplete or inaccurate, ActewAGL JGN may alter the Tariff Class assigned to a Delivery Point, in accordance with the Access Arrangement.

(c) The User may request a copy of its ELMS Data for the Delivery Points under this Agreement and any other agreement the User has with the Service Provider from the Service Provider at any time. Any such request must be in writing.
(d) Subject to ActewAGLthe Service Provider’s obligations to keep ELMS Data confidential, ActewAGL the Service Provider must provide the User with a copy of ELMS Data it has in respect of the User’s Delivery Points (or if it does not have ELMS Data for those Delivery Points, notify the User accordingly) within a reasonable time of receiving the User's request pursuant to clause 23.6(c25.6(c). If ELMS Data is confidential to a third party (including another Network User) and ActewAGL the Service Provider is not able to confirm that it has written consent to disclose that ELMS Data, ActewAGL the Service Provider is not obliged to disclose that ELMS Data to the User, but must notify the User that it is unable to disclose that information.
(e) The User may ask ActewAGL the Service Provider to update the ELMS Data for Delivery Points under this Agreement at any time. ActewAGL The Service Provider is obliged to make such a change only if the User provides evidence to ActewAGLthe Service Provider's reasonable satisfaction justifying any changes requested.
(f) ActewAGL The Service Provider may ask the User to:
(i) confirm and/or update the ELMS Data for that User’s Delivery Points (whether under this Agreement or any other agreement with the Service Provider) at any time; and
(ii) provide evidence to ActewAGLthe Service Provider's reasonable satisfaction justifying the ELMS Data provided.
(g) The User must comply with a request from ActewAGL the Service Provider pursuant to clause 23.6(f25.6(f) within 20 Business Days of receiving that request.
(h) The User warrants that all ELMS Data it provides to ActewAGL the Service Provider is accurate and complete. The User must advise ActewAGL the Service Provider as soon as practicable after becoming aware that any ELMS Data it has provided to ActewAGL the Service Provider is no longer accurate or complete.
(i) If, in the course of implementing Load Shedding, or a simulation of Load Shedding, ActewAGL the Service Provider determines that contact information contained in the ELMS Data for a Delivery Point is inaccurate, ActewAGL the Service Provider may update the ELMS Data for that Delivery Point in accordance with information provided by a Customer.
