PU rocedure for Creating a new Flow. Subject to sub-Clause (6) below, a new Flow may be Created by any Operator which provides scheduled passenger rail services over all or part of the proposed Flow or which has access rights that entitle it to do so. To Create the Flow, the relevant Operator must send a notice substantially in the form set out in Part I of Schedule 9 to the RSP.

  • Allocation and use of scarce resources Any procedures for the allocation and use of scarce resources, including frequencies, numbers and rights of way, will be carried out in an objective, timely, transparent and non-discriminatory manner. The current state of allocated frequency bands will be made publicly available, but detailed identification of frequencies allocated for specific government uses is not required.
