Public Trust Doctrine. The Public Trust Doctrine guarantees public access to, and the public right to use, navigable and public waters and the land beneath them for navigation, commerce, fishing, and other purposes. This authorization is subject to the principles of the Public Trust Doctrine regarding navigable or public waters. The AO reserves the right to grant other interests consistent with the Public Trust Doctrine.
Public Trust Doctrine. The parties agree and acknowledge that the City has certain responsibilities with respect to lands that have been dedicated to the public trust. XXX agrees to work in good faith with the City and to take such reasonable actions as may be necessary or appropriate to enable the City to carry out its responsibilities under the public trust doctrine, and agrees that the Project is intended promote the public’s access to, and use and enjoyment of, the Burlington Waterfront and to further the purposes of the public trust doctrine.
