PUBLICATION PROVISIONS. (A) Copyright: The Contractor shall be free to copyright material developed under this Agreement with the provision that the Missouri Highway and Transportation Commission and the FHWA reserve a royalty-free, non-exclusive and irrevocable license to reproduce, publish or otherwise use, and to authorize others to use, the work for government purposes.

PUBLICATION PROVISIONS. No documents produced as part of this Agreement, and in whole or part with public funds, shall be copyrighted by the Consultant. When the project uses federal funds, any final report shall contain the following: a. An acknowledgment, “Prepared in cooperation with the City, the U.S Department of Transportation, Federal Highway Administration and the Virginia Department of Transportation”; b. A disclaimer, “The contents of this report reflect the view of the Consultant who is responsible for the facts and the accuracy of the data presented herein. The contents do not necessarily reflect the official views or policies of the Federal Highway Administration or the Virginia Department of Transportation. This report does not constitute a standard, specification or regulation”; c. A statement, if published by either the City or the Consultant, giving credit to all participating agencies. As to any services performed hereunder pertaining to any project funded in whole or in part by the Commonwealth of Virginia if VDOT does not subscribe to the conclusions of the report, the following statement shall be added: “The opinions, findings, and conclusions expressed in this publication are those of the authors and do not necessarily represent those of the Virginia Department of Transportation.” The terms of this section, shall be expressly included in any third-party agreement entered into by the Consultant or by any subcontractor, agents, employees or subcontractors thereof.
PUBLICATION PROVISIONS. 1. The Project Applicant shall be free to copyright material and information obtained pursuant to this agreement provided that the Secretary and the appropriate federal agency reserves a royalty-free, nonexclusive and irrevocable cable license to reproduce, publish, or otherwise use, and to authorize others to use the work for Government purposes. 2. Publication by any party to this Agreement shall give credit to all other parties. However, if the Secretary and/or the appropriate federal agency does not wish to subscribe to the findings or conclusions of an Interim Report, the following statement shall be added: "The opinions, findings, conclusions expressed in this publication are those of the authors and not necessarily those of the Kansas Department of Transportation and/or (appropriate federal agency)." 3. In the event of failure of agreement between the Secretary and the Project Applicant relative to the publication of a Final Report, or any other reports during the period of the Agreement, the Secretary reserves the right to publish independently in which event the nonconcurrence of the Project Applicant shall be set forth in said publication, if requested by the Project Applicant.
PUBLICATION PROVISIONS. A. If at any time during a TWO the University desires to publish in any form any material developed under the TWO, the University must submit to the TWO Manager a written abstract and notification of intent to publish the material and receive the TWO Manager’s concurrence to publish. Such approval to publish shall not be unreasonably withheld. If the TWO Manager’s does not provide a written response within 30 days after receipt, the University may publish. The publication must include the following language: “The opinions, findings and conclusions expressed in this publication are those of the author(s) and not necessarily those of the Florida Department of Transportation or the U.S. Department of Transportation.” B. Both written and oral releases are considered to be within the context of publication. However, there is no intention to limit discussion of the study with small technical groups or lectures to employees or students. Lectures that describe the plans but disclose neither data nor results may be given to other groups without advance approval. C. Upon completion of a TWO, the University may publish in any form any material developed under the TWO, the University is free to publish without concurrence or review by the Department. However, the publication should prominently contain the following statement: “The opinions, findings and conclusions expressed in this publication are those of the author(s) and not necessarily those of the Florida Department of Transportation or the U.S. Department of Transportation.” D. Upon completion of a TWO: 1. The Department may elect to publish and distribute any material submitted under this agreement, or information and material contained therein. 2. The U.S. Department of Transportation may elect to distribute material submitted under this agreement with the Department’s consent, for TWOs funded with federal funds. 3. The University and the Department are free to use the data and results without restrictions. Task Work Orders funded with federal funds will also include the U.S. Department of Transportation in this provision.
