Common use of Qualifications of Arbitrators Clause in Contracts

Qualifications of Arbitrators. 1. All arbitrators shall: (a) have expertise or experience in law, international trade, digital economy, other matters covered by this Agreement or the resolution of disputes arising under international trade agreements; (b) be chosen strictly on the basis of objectivity, reliability and sound judgment; (c) be independent of, and not affiliated with or take instructions from, any Party; and (d) comply with the Rules of Conduct for the Understanding on Rules and Procedures Governing the Settlement of Disputes (as contained in document WT/DSB/RC/1 and any subsequent amendments), mutatis mutandis. 2. An individual shall not serve as an arbitrator for a dispute in which that person has participated under Article 14.4 (Good Offices and Conciliation).
