Quality and Performance. The BOCC shall be the sole judge in determining equals with regard to quality, price, or performance. All products delivered pursuant to this Contract shall be newly manufactured and the current model, unless otherwise specified in the Bid. All services shall be performed strictly in accordance with the Solicitation as incorporated into this Contract.
