Common use of Quantity Clause in Contracts

Quantity. If Seller delivers to Buyer a quantity of Goods of up to 15% more or less than the quantity set forth in the Sales Confirmation, Buyer shall not be entitled to object to or reject the Goods or any portion of them by reason of the surplus or shortfall and shall pay for such Goods the price set forth in the Sales Confirmation adjusted pro rata.

Quantity. If Seller delivers to Buyer a quantity of Goods of up to 155 % more or less than the quantity set forth in the Sales Confirmation, Buyer shall not be entitled to object to or reject the Goods or any portion of them by reason of the surplus or shortfall and shall pay for such Goods the price set forth in the Sales Confirmation adjusted pro rata.

Quantity. If Seller delivers to Buyer a quantity of Goods of up to 15% ten percent (10%) more or less than the quantity set forth in the Sales ConfirmationConfirmation or Purchase Order, Buyer shall not be entitled to object to or reject the Goods or any portion of them by reason of the surplus or shortfall and shall pay for such Goods the price set forth in the Sales Confirmation or Purchase Order adjusted pro rata.

If Seller delivers to Buyer a quantity of Goods of up to 1510% more or less than the quantity set forth in the applicable Sales Order Confirmation, Buyer shall not be entitled to object to or reject the Goods or any portion of them by reason of the surplus or shortfall and shall pay for such Goods the price set forth in the applicable Sales Order Confirmation adjusted pro rata.

Quantity. If Seller delivers to Buyer a quantity of Goods of up to 15% ten percent more or less than the quantity dollar value set forth in the Sales Confirmation, Buyer shall not be entitled to object to or reject the Goods or any portion of them by reason of the surplus or shortfall and shall pay for such Goods the price set forth in the Sales Confirmation adjusted pro rata.

Quantity. If Seller delivers to Buyer a quantity of Goods Products of up to 1525% more or less than the quantity set forth in the Sales Confirmation, Buyer shall not be entitled to object to or reject the Goods Products or any portion of them by reason of the surplus or shortfall and shall pay for such Goods Products the price set forth in the Sales Confirmation adjusted pro rata.

If Seller delivers to Buyer a quantity of Goods of up to 155% more or less than the quantity set forth in the Sales Confirmation, Buyer shall not be entitled to object to or reject the Goods or any portion of them by reason of the surplus or shortfall and shall pay for such Goods the price set forth in the Sales Confirmation adjusted pro rata.

If Seller delivers to Buyer a quantity of Goods of up to 1525% more or less than the quantity set forth in the Sales Confirmation, Buyer shall not be entitled to object to or reject the Goods or any portion of them by reason of the surplus or shortfall and shall pay for such Goods the price set forth in the Sales Confirmation adjusted pro rata.

If Seller delivers to Buyer a quantity of Goods of up to 151% more or less than the quantity set forth in the Sales Confirmation, Buyer shall not be entitled to object to or reject the Goods or any portion of them by reason of the surplus or shortfall and shall pay for such Goods the price set forth in the Sales Confirmation adjusted pro rata.

Quantity. If Seller delivers to Buyer a quantity of Goods of up to 15% ten (10)% more or less than the quantity set forth in the Sales Confirmation, Buyer shall not be entitled to object to or reject the Goods or any portion of them by reason of the surplus or shortfall and Buyer shall pay for such Goods in an amount specified by the price set forth in the Sales Confirmation adjusted pro rata.

Quantity. If Seller delivers to Buyer a quantity of Goods of up to 1510% more or less than the quantity set forth in the Sales Order Confirmation, Buyer shall not be entitled to object to or reject the Goods or any portion of them by reason of the surplus or shortfall and shall pay for such Goods the price set forth in the Sales Order Confirmation adjusted pro rata.

Quantity. If Seller delivers to Buyer a quantity of Goods of up to 155% more or less than the quantity set forth in the Sales ConfirmationOrder, or any other variance in order quantity agreed to between Buyer and Seller, Buyer shall not be entitled to object to or reject the Goods or any portion of them by reason of the surplus or shortfall and shall pay for such Goods the price set forth in the Sales Confirmation Order adjusted pro rata.

If Seller delivers to Buyer a quantity of Goods of up to 1510% more or less than the quantity set forth in the Sales Confirmation, Buyer shall not be entitled to object to or reject the Goods or any portion of them by reason of the surplus or shortfall and shall pay for such Goods the price set forth in the Sales Confirmation adjusted pro rata.

Quantity. If Seller delivers to Buyer a quantity of Goods of up to 155% more or less than the quantity set forth in the Sales ConfirmationAcknowledgement, Buyer shall not be entitled to object to or reject the Goods or any portion of them by reason of the surplus or shortfall and shall pay for such Goods the price set forth in the Sales Confirmation Acknowledgement adjusted pro rata.

Quantity. If Seller delivers to Buyer a quantity of Goods of up to 155% more or less than the quantity set forth in the Sales ConfirmationOrder, Buyer shall not be entitled to object to or reject the Goods or any portion of them by reason of the surplus or shortfall and shall pay for such Goods the price set forth in the Sales Confirmation Order adjusted pro rata.

If Seller delivers to Buyer a quantity of Goods of up to 155% more or less than 3 the quantity set forth in the Sales Confirmation, Buyer shall not be entitled to object to or reject the Goods or any portion of them by reason of the surplus or shortfall and shall pay for such Goods the price set forth in the Sales Confirmation adjusted pro rata.

If Seller delivers to Buyer a quantity of Goods of up to 15% five percent (5%) more or less than the quantity set forth in the Sales Confirmation, Buyer shall not be entitled to object to or reject the Goods or any portion of them by reason of the surplus or shortfall and shall pay for such Goods the price set forth in the Sales Confirmation adjusted pro rata.

Quantity. If Seller delivers to Buyer a quantity of Goods of up to 1590% more or less than the quantity set forth in the Sales Confirmation, Buyer shall not be entitled to object to or reject the Goods or any portion of them by reason of the surplus or shortfall and shall pay for such Goods the price set forth in the Sales Confirmation adjusted pro rata.

Quantity. If Seller delivers to Buyer a quantity of Goods of up to 15% more or fifty percent (50%) less than the quantity set forth in the Sales Confirmation, Buyer shall not be entitled to object to or reject the Goods or any portion of them by reason of the surplus or shortfall and shall pay for such Goods the price set forth in the Sales Confirmation adjusted pro rata.

Quantity. If Seller delivers to Buyer a quantity of Goods of up to 1520% more or less than the quantity set forth in the Sales Confirmation, Buyer shall not be entitled to object to or reject the Goods or any portion of them by reason of delivery due to the surplus or shortfall and shall pay for such Goods at the price set forth in the Sales Confirmation adjusted pro rata. Seller shall have no right to reject quantities in excess.

Quantity. If Seller delivers to Buyer a quantity of Goods of up to 15% five percent (5%) more or less than the quantity set forth in the Sales ConfirmationOrder, Buyer shall not be entitled to object to or reject the Goods or any portion of them by reason of the surplus or shortfall and shall pay for such Goods the price set forth in the Sales Confirmation Order adjusted pro rata.

Quantity. If Seller delivers to Buyer a quantity of Goods of up to 15% more or less than the quantity of Goods set forth in the Sales ConfirmationPurchase Order, Buyer shall not be entitled to object to or reject the Goods or any portion of them by reason of the surplus or shortfall and shall pay for such Goods the price set forth in the Sales Confirmation Purchase Order adjusted pro rata.

(a) If Seller delivers to Buyer a quantity of Goods of up to 155% more or less than the quantity set forth in the Sales Confirmation, Buyer shall not be entitled to object to or reject the Goods or any portion of them by reason of the surplus or shortfall and shall pay for such Goods the price set forth in the Sales Confirmation adjusted pro rata.

If Seller delivers to Buyer a quantity of Goods of up to 1510 % more or less than the quantity set forth in the Sales Confirmation, Buyer shall not be entitled to object to or reject the Goods or any portion of them by reason of the surplus or shortfall and shall pay for such Goods the price set forth in the Sales Confirmation adjusted pro rata.
