Common use of Readmission in error Clause in Contracts

Readmission in error. The Requesting State shall take back any person readmitted by the Requested State if it is established, within a period of three months after the transfer of the person concerned, that the requirements laid down in Articles 2 to 5 of this Agreement are not met. In such cases the procedural provisions of this Agreement shall apply mutatis mutandis and all available information relating to the actual identity and nationality of the person to be taken back shall be provided.

Readmission in error. The Requesting State shall take back any person readmitted by the Requested State if it is established, established within a period of three months 6 months, and in case of third-country nationals or stateless persons 12 months, after the transfer of the person concerned, that the requirements laid down in Articles 2 to 5 of this Agreement are not met. In such cases the procedural provisions of this Agreement shall apply mutatis mutandis and all available information relating to the actual identity and nationality of the person to be taken back shall be provided.

In such cases the procedural provisions of this Agreement shall apply mutatis mutandis and all available information relating to the actual identity and nationality citizenship of the person to be taken back shall be provided.

The Requesting State shall take back any person readmitted by the Requested State if it is established, within a period of three (3) months after the transfer of the person concerned, that the requirements laid down in Articles 2 to 5 and 3 of this Agreement are were not met. In such cases the procedural provisions of this Agreement shall apply mutatis mutandis and all available information relating to the actual identity and nationality of the person to be taken back shall be provided. In this case the original documents in respect of a person should be returned to the competent authorities of the Requesting State.
