Common use of REAL ESTATE BROKER Clause in Contracts

REAL ESTATE BROKER. Landlord and Tenant acknowledge and agree that: (i) Landlord has been represented in connection with this First Amendment by Amerimar Realty Management Co. Colorado ("Amerimar") as Landlord's agent and by Xxxxx X. X. Xxxx, Broker, Ltd. ("Xxxx") as Landlord's subagent, and (ii) Tenant has been represented in connection with this First Amendment by Xxxxxxx Realty Corporation (Xxxx X. Xxxxxx) ("Xxxxxxx") as Tenant's agent. Tenant agrees to indemnify, defend and hold Landlord harmless from and against any claims, for a commission or other compensation in connection with this First Amendment, made by any broker or finder (other than Amerimar, Xxxx and Xxxxxxx) who claim to have dealt with or communicated to Tenant in connection with this First Amendment, PROVIDED THAT Landlord has not in fact retained such broker or finder. Landlord agrees to indemnify, defend and hold Tenant harmless from and against any claims, for a commission or other compensation in connection with this First Amendment, made by any broker or finder who claim to have dealt with or communicated to Landlord in connection with this First Amendment, provided that Tenant has not in fact retained such broker or finder.

REAL ESTATE BROKER. Landlord Tenant represents that Tenant has dealt with (and Tenant acknowledge only with) The Xxxx Xxxx Company (“JBC”) and agree that: U.S. Equities Realty, Inc. (i“U.S. Equities”) Landlord has been represented as brokers in connection with this First Amendment by Amerimar Realty Management Co. Colorado ("Amerimar") as Landlord's agent and by Xxxxx X. X. Xxxx, Broker, Ltd. ("Xxxx") as Landlord's subagentLease, and that insofar as Tenant knows, no other broker negotiated this Lease or is entitled to any commission in connection therewith. Landlord represents that Landlord has dealt with (iiand only with) Tenant has been represented JBC and U.S. Equities as brokers in connection with this First Amendment by Xxxxxxx Realty Corporation (Xxxx X. Xxxxxx) ("Xxxxxxx") Lease and that insofar as Tenant's agentLandlord knows, no other broker negotiated this Lease or is entitled to any commission in connection therewith. Landlord shall pay any commission owed to JBC in connection with this Lease and Tenant shall pay any commission owed to U.S. Equities in connection with this Lease. Tenant agrees to indemnify, defend and hold Landlord and its partners, employees, agents, their officers and partners, harmless from and against any claims, for a commission or other compensation in connection with this First Amendment, claims made by any broker or finder (other than Amerimar, Xxxx and Xxxxxxx) who claim to have dealt including U.S. Equities based on an agreement with Tenant for a commission or communicated to Tenant fee in connection with this First AmendmentLease, PROVIDED THAT provided that Landlord has not in fact retained such broker or finder. Landlord agrees to indemnify, defend and hold Tenant and its partners, employees, agents, their officers and partners, harmless from and against any claims, for a commission or other compensation in connection with this First Amendment, claims made by any broker or finder who claim to have dealt including JBC based on an agreement with Landlord for a commission or communicated to Landlord fee in connection with this First AmendmentLease, provided that Tenant has not in fact retained such broker or finder.

REAL ESTATE BROKER. 51.01 Landlord and Tenant acknowledge and agree that: (i) Landlord has been represented in connection with this First Amendment Lease by Amerimar Realty Management Co. Colorado Co.-Colorado ("AmerimarAgent") and by Silverbrae Holdings, Inc. (Gxxxx R. X. Xxxx and Hxxxx XxXxxxxx) ("Silverbrae") as Landlord's agent and by Xxxxx X. X. Xxxx, Broker, Ltd. ("Xxxx") as Landlord's subagentagents, and (ii) Tenant has been represented in connection with this First Amendment Lease by Xxxxxxx Realty Corporation The Staubach Company (Xxxx X. XxxxxxLxxxxxx Xxxxx and Txx Xxxxx) ("XxxxxxxSxxxxxxx") as Tenant's ’s agent. Tenant agrees to indemnify, defend and hold Landlord harmless from and against any claims, for a commission or other compensation in connection with this First AmendmentLease, made by any broker or finder (other than AmerimarAgent, Xxxx Silverbrae and XxxxxxxStaubach) who claim to have dealt with or communicated to Tenant in connection with this First Amendment, PROVIDED THAT Lease provided that the Landlord has not in fact retained such broker or finder. Landlord agrees to pay Agent, Silverbrae and Staubach pursuant to the terms of separate agreements, for their services rendered in connection with this Lease, and agrees to indemnify, defend and hold Tenant harmless from and against any claims, for a commission or other compensation in connection with this First AmendmentLease, made by any broker or finder who claim to have dealt with or communicated to Landlord in connection with this First Amendment, Lease provided that Tenant has not in fact retained such broker or finder.

Xxxxx Xxxxxxx, Xxx Xxxxxxxxx and Xxx Xxxxxx) ("XxxxxxxXxxxxxxx") as Tenant's agent. Tenant agrees to indemnify, defend and hold Landlord harmless from and against any claims, for a commission or other compensation in connection with this First Amendment, made by any broker or finder (other than AmerimarAgent, Xxxx and XxxxxxxStaubach) who claim to have dealt with or communicated to Tenant in connection with this First Amendment, PROVIDED THAT Amendment provided that Landlord has not in fact retained such broker or finder. Landlord agrees to pay Agent, Xxxx and Xxxxxxxx pursuant to the terms of separate agreements, for their services rendered in connection with this First Amendment, and agrees to indemnify, defend and hold Tenant harmless from and against any claims, for a commission or other compensation in connection with this First Amendment, made by any broker or finder who claim to have dealt with or communicated to Landlord in connection with this First Amendment, Amendment provided that Tenant has not in fact retained such broker or finder.

REAL ESTATE BROKER. Landlord and Tenant acknowledge and agree that: (i) Landlord has been represented in connection with this First Amendment Lease by Amerimar Realty Management Co. Colorado ("Amerimar") Agent as Landlord's agent and by Xxxxx X. X. R. D. Xxxx, Broker, Ltd. ("Xxxx") as Landlord's subagent, and (ii) Tenant has been represented in connection with this First Amendment Lease by Xxxxxxx Realty Corporation The Staubach Company (Xxxx X. Xxxxx Xxxxxxx, Xxx Xxxxxxxxx and Xxx Xxxxxx) ("XxxxxxxXxxxxxxx") as Tenant's agent. Tenant agrees to indemnify, defend and hold Landlord harmless from and against any claims, for a commission or other compensation in connection with this First AmendmentLease, made by any broker or finder (other than AmerimarAgent, Xxxx and XxxxxxxStaubach) who claim to have dealt with or communicated to Tenant in connection with this First Amendment, PROVIDED THAT Lease provided that Landlord has not in fact retained such broker or finder. Landlord agrees to pay Agent, Xxxx and Xxxxxxxx pursuant to the terms of separate agreements, for their services rendered in connection with this Lease, and agrees to indemnify, defend and hold Tenant harmless from and against any claims, for a commission or other compensation in connection with this First AmendmentLease, made by any broker or finder who claim to have dealt with or communicated to Landlord in connection with this First Amendment, Lease provided that Tenant has not in fact retained such broker or finder.

REAL ESTATE BROKER. Landlord and Tenant acknowledge and agree that: (i) Landlord has been represented in connection with this First Third Amendment by Amerimar Realty Management Co. Colorado Co.-Colorado ("Amerimar") as Landlord's agent and by Xxxxx X. X. Xxxx, Broker, Ltd. ("Xxxx") as Landlord's subagent, and (ii) Tenant has been represented in connection with this First Third Amendment by Xxxxxxx Realty Corporation (Xxxx X. Xxxxxx) ("Xxxxxxx") as Tenant's agent. Tenant agrees to indemnify, defend and hold Landlord harmless from and against any claims, for a commission or other compensation in connection with this First Third Amendment, made by any broker or finder (other than Amerimar, Xxxx and Xxxxxxx) who claim to have dealt with or communicated to Tenant in connection with this First Third Amendment, PROVIDED THAT provided that Landlord has not in fact retained such broker or finder. Landlord agrees to indemnify, defend and hold Tenant harmless from and against any claims, for a commission or other compensation in connection with this First Third Amendment, made by any broker or finder who claim to have dealt with or communicated to Landlord in connection with this First Third Amendment, provided that Tenant has not in fact retained such broker or finder.

REAL ESTATE BROKER. Landlord Tenant represents that Tenant has dealt with (and Tenant acknowledge only with) Fallxx Xxxxx & X'Coxxxx ("XHO"), Tanquay-Burkx-Xxxxxxxx ("XBS") and agree that: (i) Landlord has been represented in connection with this First Amendment by Amerimar Realty Management Co. Colorado Adamx Xxxagement Company, Inc. ("Amerimar") as Landlord's agent and by Xxxxx X. X. Xxxx, Broker, Ltd. ("Xxxx") as Landlord's subagent, and (ii) Tenant has been represented brokers in connection with this First Amendment by Xxxxxxx Realty Corporation (Xxxx X. Xxxxxx) ("Xxxxxxx") Lease, and that insofar as Tenant's agentTenant knows, no other broker negotiated this Lease or is entitled to any commission in connection therewith. Tenant agrees to indemnify, defend and hold Landlord harmless from and against any claims, for a commission or other compensation in connection with this First AmendmentLease (including, without limitation, any claim arising in connection with a broker's lien), made by any broker or finder (other than Amerimar, Xxxx and Xxxxxxx) the brokers named above who claim claims to have dealt with or communicated to Tenant in connection with this First AmendmentLease, PROVIDED THAT provided that Landlord has not in fact retained such broker or finder. Landlord represents that Landlord has dealt with (and only with) FHO, TBS and Amerimar as brokers in connection with this Lease, and that insofar as Landlord knows, no other broker negotiated this Lease or is entitled to any commission in connection therewith. Landlord agrees to indemnify, defend and hold Tenant harmless from and against any claims, for a commission or other compensation in connection with this First AmendmentLease (including, without limitation, any claim arising in connection with a broker's lien), made by any broker or finder broker, including FHO, TBS and Amerimar, who claim claims to have dealt with or communicated to Landlord in connection with this First AmendmentLease, provided that Tenant has not in fact retained such broker or finder.
