Recapture Obligations. The City warrants and represents to Owner and/or Applicant that no recapture fees are or shall become due and payable to any person or entity as a result of the annexation of the Property to the City or as a result of connection to any utility improvements serving the Property, except for a charge of $1,350.00 per dwelling unit and a charge of $ per acre for non-residential property payable for portions of the property for which the City of Batavia provides sanitary sewer service.
