Common use of RECAPTURE OF FUNDS Clause in Contracts

RECAPTURE OF FUNDS. The discretionary right of the GLO to terminate for convenience under Section 2.02 notwithstanding, the GLO may terminate the Contract and recapture and be reimbursed for any payments, including any unapproved expenditures, that the GLO makes that (a) exceed the maximum allowable rates; (b) are not allowed under applicable laws, rules, or regulations; or (c) are otherwise inconsistent with this Contract.

RECAPTURE OF FUNDS. The discretionary right of the GLO to terminate for convenience under Section SECTION 2.02 notwithstanding, Provider understands and agrees that the GLO may terminate the Contract and recapture and be reimbursed for any payments, including any unapproved expenditures, that payments the GLO makes that (ai) exceed the maximum allowable rates; (bii) are not allowed under applicable laws, rules, or regulations; or (ciii) are otherwise inconsistent with this Contract, including any unapproved expenditures.
