Common use of Records and Billing Verification Rights Clause in Contracts

Records and Billing Verification Rights. 13.1Seller and Buyer each shall keep complete and accurate records with respect to its performance under this Agreement and shall maintain such data for a period of two (2) years after final billing for verification by the other Party. In the event of any billing dispute, all such records pertaining to the dispute shall be maintained until such later time as the billing dispute is resolved. If a billing dispute establishes that any xxxx submitted to and paid by Buyer was for an amount greater than properly chargeable under this Agreement, Seller shall refund to Buyer the excess amount collected together with interest calculated from the date of payment to the refund date in accordance with the regulations of the FERC applicable to the payment of interest on refunds. If a billing dispute establishes that any xxxx submitted to and paid by Buyer was for an amount less than properly chargeable under this Agreement, Buyer shall make such additional payment to Seller, together with interest calculated from the due date to the date of payment in accordance with regulations of the FERC applicable to the payment of interest on refunds.
