Common use of Records of Borings Clause in Contracts

Records of Borings. If borings were taken for this project, the records of the borings, and the cores and samples therefrom along with any similar records of other borings in the vicinity of the project in the possession of the Department may be examined by the Contractor in the offices of the Department. It should be distinctly understood, however, that the information therein contained may not disclose the true conditions that may be encountered during the course of the Work under the Contract. Said information is not part of the Contract and the Contractor is not to rely upon it in forming conclusions as to the nature of the conditions to be encountered. The Contractor hereby specifically agrees to not hold the City liable nor make any claim against the City for damage or extra Work related to the fact that any condition encountered during the progress of its Work differs from that assumed by the Contractor because of any such borings, cores or samples.
