Common use of Records Ownership Clause in Contracts

Records Ownership. Contractor acknowledges that in providing NPS/NPA services to student, he/she is “acting for” the District under 20 U.S.C. Section 1232g, the Family Educational and Privacy Rights Act (“FERPA”). Contractor is thus subject to the FERPA standards of confidentiality regarding services to student. All records as defined in the current MASTER CONTRACT and produced in the course of providing said services are the property of the District, “Student Records” shall include, but are not limited to, records, files, documents, materials, reports, summaries, graphs, notes, data, worksheets, work and assignments relating to the student, transcripts, and the student’s progress in receiving said services. Contractor understands that he/she must produce and maintain said records on the students, at the very least, in accordance with the standard of acceptable practice of a NPS/NPA. These records will be provided to the District on a quarterly basis (defined as the first day of the months of January, April, June, and October.) or as requested by the District, and will become part of the student’s education record as defined under FERPA and state law.
