RECORDS REQUIREMENTS AND RECORDS RETENTION. 3.5.1 HMO must keep all records required to be created and retained under this contract. Records related to Members served in this service area must be made available in HMO's local office when requested by TDH. All records must be retained for a period of five (5) years unless otherwise specified in this contract. Original records must be kept in the form they were created in the regular course of business for a minimum of two (2) years following the end of the contract period. Microfilm, digital or electronic records may be substituted for the original records after the first two (2) years, if the retention system is reliable and is supported by a retrieval system which allows reasonable access to the records. All copies of original records must be made using guidelines and procedures approved by TDH, if the original documents will no longer be available or accessible.
