Common use of Recoverable Losses Clause in Contracts

Recoverable Losses. Subject to Clause 36.2 (Financial Limits), and notwithstanding Clause 36.3 (Non-recoverable Losses), the Supplier acknowledges that the Customer may, amongst other things, recover from the Supplier the following Losses incurred by the Customer to the extent that they arise as a result of a Default by the Supplier: any additional operational and/or administrative costs and expenses incurred by the Customer, including costs relating to time spent by or on behalf of the Customer in dealing with the consequences of the Default; any wasted expenditure or charges; the additional cost of procuring Replacement Goods and/or Services for the remainder of the Call Off Contract Period and/or replacement Deliverables, which shall include any incremental costs associated with such Replacement Goods and/or Services and/or replacement Deliverables above those which would have been payable under this Call Off Contract; any compensation or interest paid to a third party by the Customer; and any fine, penalty or costs incurred by the Customer pursuant to Law.

Recoverable Losses. Recoverable Losses. Subject to Clause 36.2 (Financial Limits), and notwithstanding Clause 36.3 (Non-recoverable Losses), the Supplier Service Provider acknowledges that the Customer may, amongst other things, recover from the Supplier Service Provider the following Losses incurred by the Customer to the extent that they arise as a result of a Default by the SupplierService Provider: any additional operational and/or administrative costs and expenses incurred by the Customer, including costs relating to time spent by or on behalf of the Customer in dealing with the consequences of the Default; any wasted expenditure or charges; the additional cost of procuring Replacement Goods and/or Services for the remainder of the Call Off Contract Period and/or replacement Deliverables, which shall include any incremental costs associated with such Replacement Goods and/or Services and/or replacement Deliverables above those which would have been payable under this Call Off Contract; any compensation or interest paid to a third party by the Customer; and any fine, penalty or costs incurred by the Customer pursuant to Law.

Subject to Clause 36.2 40.2 (Financial Limits), and notwithstanding Clause 36.3 40.3 (Non-recoverable Losses), the Supplier acknowledges that the Customer may, amongst other things, recover from the Supplier the following Losses incurred by the Customer to the extent that they arise as a result of a Default by the Supplier: any additional operational and/or administrative costs and expenses incurred by the Customer, including costs relating to time spent by or on behalf of the Customer in dealing with the consequences of the Default; any wasted expenditure or charges; the additional cost of procuring Replacement Goods and/or Services for the remainder of the Call Off Contract Period and/or replacement Deliverables, which shall include any incremental costs associated with such Replacement Goods and/or Services and/or replacement Deliverables above those which would have been payable under this Call Off Contract; any compensation or interest paid to a third party by the Customer; and any fine, penalty or costs incurred by the Customer pursuant to Law.

Subject to Clause 36.2 39.2 (Financial Limits), and notwithstanding Clause 36.3 39.3 (Non-recoverable Losses), the Supplier acknowledges that the Customer may, amongst other things, recover from the Supplier the following Losses incurred by the Customer to the extent that they arise as a result of a Default by the Supplier: any additional operational and/or administrative costs and expenses incurred by the Customer, including costs relating to time spent by or on behalf of the Customer in dealing with the consequences of the Default; any wasted expenditure or charges; the additional cost of procuring Replacement Goods Products and/or Services for Servicesfor the remainder of the Call Off Contract Period and/or replacement Deliverables, which shall include any incremental costs associated with such Replacement Goods Products and/or Services and/or replacement Deliverables above those which would have been payable under this Call Off Contract; any compensation or interest paid to a third party by the Customer; and any fine, penalty or costs incurred by the Customer pursuant to Law.

Recoverable Losses. Subject to Clause 36.2 (Financial Limits), and notwithstanding Clause 36.3 (Non-recoverable Losses), the Supplier acknowledges that the Customer Contracting Authority may, amongst other things, recover from the Supplier the following Losses incurred by the Customer Contracting Authority to the extent that they arise as a result of a Default by the Supplier: any additional operational and/or administrative costs and expenses incurred by the CustomerContracting Authority, including costs relating to time spent by or on behalf of the Customer Contracting Authority in dealing with the consequences of the Default; any wasted expenditure or charges; the additional cost of procuring Replacement Goods and/or Services for the remainder of the Call Off Contract Period and/or replacement Deliverables, which shall include any incremental costs associated with such Replacement Goods and/or Services and/or replacement Deliverables above those which would have been payable under this Call Off Contract; any compensation or interest paid to a third party by the CustomerContracting Authority; and any fine, penalty or costs incurred by the Customer Contracting Authority pursuant to Law.

Recoverable Losses. 36.4.1 Subject to Clause 36.2 (Financial Limits), and notwithstanding Clause 36.3 (Non-recoverable Losses), the Supplier acknowledges that the Customer may, amongst other things, recover from the Supplier the following Losses incurred by the Customer to the extent that they arise as a result of a Default by the Supplier: any additional operational and/or administrative costs and expenses incurred by the Customer, including costs relating to time spent by or on behalf of the Customer in dealing with the consequences of the Default; any wasted expenditure or charges; the additional cost of procuring Replacement Goods and/or Services for the remainder of the Call Off Contract Period and/or replacement Deliverables, which shall include any incremental costs associated with such Replacement Goods and/or Services and/or replacement Deliverables above those which would have been payable under this Call Off Contract; any compensation or interest paid to a third party by the Customer; and any fine, penalty or costs incurred by the Customer pursuant to Law.

Subject to Clause 36.2 33.2 (Financial Limits), and notwithstanding Clause 36.3 (Non33.3(Non-recoverable Losses), the Supplier acknowledges that the Customer may, amongst other things, recover from the Supplier the following Losses incurred by the Customer to the extent that they arise as a result of a Default by the Supplier: any additional operational and/or administrative costs and expenses incurred by the Customer, including costs relating to time spent by or on behalf of the Customer in dealing with the consequences of the Default; any wasted expenditure or charges; the additional cost of procuring Replacement Goods and/or Services for the remainder of the Call Call-Off Contract Period and/or replacement Deliverables, which shall include any incremental costs associated with such Replacement Goods and/or Services and/or replacement Deliverables above those which would have been payable under this Call Call-Off Contract; any compensation or interest paid to a third party by the Customer; and any fine, penalty or costs incurred by the Customer pursuant to Law.

Subject to Clause 36.2 51.2 (Financial Limits), and notwithstanding Clause 36.3 51.3 (Non-recoverable Losses), the Supplier acknowledges that the Customer may, amongst other things, recover from the Supplier the following Losses incurred by the Customer to the extent that they arise as a result of a Default by the Supplier: any additional operational and/or administrative costs and expenses incurred by the Customer, including costs relating to time spent by or on behalf of the Customer in dealing with the consequences of the Default; any wasted expenditure or charges; the additional cost of procuring Replacement Goods and/or Services for the remainder of the Call Off Contract Period and/or replacement Deliverables, which shall include any incremental costs associated with such Replacement Goods and/or Services and/or replacement Deliverables above those which would have been payable under this Call Off Contract; any compensation or interest paid to a third party by the Customer; and any fine, penalty or costs incurred by the Customer pursuant to Law.

Subject to Clause 36.2 45.2 (Financial Limits), and notwithstanding Clause 36.3 45.3 (Non-recoverable Losses), the Supplier acknowledges that the Customer may, amongst other things, recover from the Supplier the following Losses incurred by the Customer to the extent that they arise as a result of a Default by the Supplier: any additional operational and/or administrative costs and expenses incurred by the Customer, including costs relating to time spent by or on behalf of the Customer in dealing with the consequences of the Default; any wasted expenditure or charges; the additional cost of procuring Replacement Goods and/or Services for the remainder of the Call Off Contract Period and/or replacement Deliverables, which shall include any incremental costs associated with such Replacement Goods and/or Services and/or replacement Deliverables above those which would have been payable under this Call Off Contract; any compensation or interest paid to a third party by the Customer; and any fine, penalty or costs incurred by the Customer pursuant to Law.

Subject to Clause 36.2 26.2 (Financial Limits), and notwithstanding Clause 36.3 26.3 (Non-recoverable Losses), the Supplier acknowledges that the Customer may, amongst other things, recover from the Supplier the following Losses incurred by the Customer to the extent that they arise as a result of a Default by the Supplier: any additional operational and/or administrative costs and expenses incurred by the Customer, including costs relating to time spent by or on behalf of the Customer in dealing with the consequences of the Default; any wasted expenditure or charges; the additional cost of procuring Replacement Goods and/or Services for the remainder of the Call Off Contract Period and/or replacement Deliverables, which shall include any incremental costs associated with such Replacement Goods and/or Services and/or replacement Deliverables above those which would have been payable under this Call Off Contract; any compensation or interest paid to a third party by the Customer; and any fine, penalty or costs incurred by the Customer pursuant to Law.

Subject to Clause 36.2 36.2.1 (Financial Limits), and notwithstanding Clause 36.3 36.3.1 (Non-recoverable Losses), the Supplier acknowledges that the Customer may, amongst other things, recover from the Supplier the following direct Losses incurred by the Customer to the extent that they arise as a result of a Default by the Supplier: any additional operational and/or administrative costs and expenses incurred by the Customer, including costs relating to time spent by or on behalf of the Customer in dealing with the consequences of the Default; any wasted expenditure or charges; the additional cost of procuring Replacement Goods and/or Services for the remainder of the Call Off Contract Period and/or replacement Deliverables, which shall include any incremental costs associated with such Replacement Goods and/or Services and/or replacement Deliverables above those which would have been payable under this Call Off Contract; any compensation or interest paid to a third party by the Customer; and any fine, penalty or costs incurred by the Customer pursuant to Law.

Subject to Clause 36.2 47.2 (Financial Limits), and notwithstanding Clause 36.3 47.3 (Non-recoverable Losses), the Supplier acknowledges that the Customer may, amongst other things, recover from the Supplier the following Losses incurred by the Customer to the extent that they arise as a result of a Default by the Supplier: any additional operational and/or administrative costs and expenses incurred by the Customer, including costs relating to time spent by or on behalf of the Customer in dealing with the consequences of the Default; any wasted expenditure or charges; the additional cost of procuring Replacement Goods and/or Services for the remainder of the Call Off Contract Period and/or replacement Deliverables, which shall include any incremental costs associated with such Replacement Goods and/or Services and/or replacement Deliverables above those which would have been payable under this Call Off Contract; any compensation or interest paid to a third party by the Customer; and any fine, penalty or costs incurred by the Customer pursuant to Law.

Subject to Clause 36.2 34.2 (Financial Limits), and notwithstanding Clause 36.3 34.3 (Non-recoverable Losses), the Supplier acknowledges that the Customer may, amongst other things, recover from the Supplier the following Losses incurred by the Customer to the extent that they arise as a result of a Default by the Supplier: any additional operational and/or administrative costs and expenses incurred by the Customer, including costs relating to time spent by or on behalf of the Customer in dealing with the consequences of the Default; any wasted expenditure or charges; the additional cost of procuring Replacement Goods and/or Services for the remainder of the Call Off Contract Period and/or replacement Deliverables, which shall include any incremental costs associated with such Replacement Goods and/or Services and/or replacement Deliverables above those which would have been payable under this Call Off Contract; any compensation or interest paid to a third party by the Customer; and any fine, penalty or costs incurred by the Customer pursuant to Law.

Subject to Clause 36.2 38.2 (Financial Limits), and notwithstanding Clause 36.3 38.3 (Non-recoverable Losses), the Supplier acknowledges that the Customer may, amongst other things, recover from the Supplier the following Losses incurred by the Customer to the extent that they arise as a result of a Default by the Supplier: any additional operational and/or administrative costs and expenses incurred by the Customer, including costs relating to time spent by or on behalf of the Customer in dealing with the consequences of the Default; any wasted expenditure or charges; the additional cost of procuring Replacement Goods and/or Services for the remainder of the Call Off Contract Period and/or replacement Deliverables, which shall include any incremental costs associated with such Replacement Goods and/or Services and/or replacement Deliverables above those which would have been payable under this Call Off Contract; any compensation or interest paid to a third party by the Customer; and any fine, penalty or costs incurred by the Customer pursuant to Law.

Recoverable Losses. Subject to Clause 36.2 45.2 (Financial Limits), and notwithstanding Clause 36.3 45.3 (Non-recoverable Losses), the Supplier acknowledges that the Customer may, amongst other things, recover from the Supplier the following Losses incurred by the Customer to the extent that they arise as a result of a Default by the Supplier: any additional operational and/or administrative costs and expenses incurred by the Customer, including costs relating to time spent by or on behalf of the Customer in dealing with the consequences of the Default; any wasted expenditure or charges; the additional cost of procuring Replacement Goods and/or Services for the remainder of the Call Off Contract Lease Agreement Period and/or replacement Deliverables, which shall include any incremental costs associated with such Replacement Goods and/or Services and/or replacement Deliverables above those which would have been payable under this Call Off ContractLease Agreement; any compensation or interest paid to a third party by the Customer; and any fine, penalty or costs incurred by the Customer pursuant to Law.

Recoverable Losses. Subject to Clause 36.2 48.2 (Financial Limits), and notwithstanding Clause 36.3 48.3 (Non-recoverable Losses), the Supplier acknowledges that the Customer may, amongst other things, recover from the Supplier the following Losses incurred by the Customer to the extent that they arise as a result of a Default by the Supplier: any additional operational and/or administrative costs and expenses incurred by the Customer, including costs relating to time spent by or on behalf of the Customer in dealing with the consequences of the Default; any wasted expenditure or charges; the additional cost of procuring Replacement Goods and/or Services and the delivery of purchased Goods for the remainder of the Call Off Contract Period and/or replacement Deliverables, which shall include any incremental costs associated with such Replacement Goods and/or Services and the delivery of purchased Goods and/or replacement Deliverables above those which would have been payable under this Call Off Contract; any compensation or interest paid to a third party by the Customer; and any fine, penalty or costs incurred by the Customer pursuant to Law.

Recoverable Losses. 36.4.1 Subject to Clause 36.2 (Financial Limits), and notwithstanding Clause 36.3 (Non-Non- recoverable Losses), the Supplier acknowledges that the Customer may, amongst other things, recover from the Supplier the following Losses incurred by the Customer to the extent that they arise as a result of a Default by the Supplier: : (a) any additional operational and/or administrative costs and expenses incurred by the Customer, including costs relating to time spent by or on behalf of the Customer in dealing with the consequences of the Default; ; (b) any wasted expenditure or charges; ; (c) the additional cost of procuring Replacement Goods and/or Services for the remainder of the Call Off Contract Period and/or replacement Deliverables, which shall include any incremental costs associated with such Replacement Goods and/or Services and/or replacement Deliverables above those which would have been payable under this Call Off Contract; ; (d) any compensation or interest paid to a third party by the Customer; and and (e) any fine, penalty or costs incurred by the Customer pursuant to Law.

Subject to Clause 36.2 46.2 (Financial Limits), and notwithstanding Clause 36.3 46.3 (Non-recoverable Losses), the Supplier acknowledges that the Customer may, amongst other things, recover from the Supplier the following Losses incurred by the Customer to the extent that they arise as a result of a Default by the Supplier: any additional operational and/or administrative costs and expenses incurred by the Customer, including costs relating to time spent by or on behalf of the Customer in dealing with the consequences of the Default; any wasted expenditure or charges; the additional cost of procuring Replacement Goods and/or Services for the remainder of the Call Off Contract Period and/or replacement Deliverables, which shall include any incremental costs associated with such Replacement Goods and/or Services and/or replacement Deliverables above those which would have been payable under this Call Off Contract; any compensation or interest paid to a third party by the Customer; and any fine, penalty or costs incurred by the Customer pursuant to Law.

Subject to Clause 36.2 49.2 (Financial Limits), and notwithstanding Clause 36.3 49.3 (Non-recoverable Losses), the Supplier acknowledges that the Customer may, amongst other things, recover from the Supplier the following Losses incurred by the Customer to the extent that they arise as a result of a Default by the Supplier: any additional operational and/or administrative costs and expenses incurred by the Customer, including costs relating to time spent by or on behalf of the Customer in dealing with the consequences of the Default; any wasted expenditure or charges; the additional cost of procuring Replacement Goods and/or Services for the remainder of the Call Off Contract Period and/or replacement Deliverables, which shall include any incremental costs associated with such Replacement Goods and/or Services and/or replacement Deliverables above those which would have been payable under this Call Off Contract; any compensation or interest paid to a third party by the Customer; and any fine, penalty or costs incurred by the Customer pursuant to Law.
