Exclusion of implied terms. (a) To the maximum extent permitted by law and except in the case of fraud or as otherwise expressly provided in this agreement: (i) all terms, conditions, warranties or statements (whether express, implied, written, oral, collateral, statutory or otherwise) which would be implied or incorporated into this agreement as having been given by a party in favour of any other party (implied terms) are excluded; (ii) each party disclaims all liability in relation to any implied terms; and (iii) each party waives all rights and remedies which might otherwise be available to that party in relation to any implied terms. (b) The Operator makes no representation and gives no warranty as to the accuracy, suitability or fitness for purpose of the Exchange, any Products, any information provided through the Trading System and none of the Exchange, any Product or the information provided purports to be suitable for any particular Member’s business objectives, financial situation or needs.
