Common use of Recovery from Surety Clause in Contracts

Recovery from Surety. In addition to other provision set forth herein related to the recovery of attorney’s fees, Subcontractor and/or Subcontractor’s surety (if applicable) shall reimburse the Contractor for all costs, expenses, and attorney's fees incurred by the Contractor in connection with a default by the Subcontractor. The obligation to compensate Contractor for reasonable attorney’s fees shall be incorporated by reference to any performance bond provided by Subcontractor.
