Common use of Recreational Services Clause in Contracts

Recreational Services. If you have undertaken to participate in our Services for the purposes of recreation, enjoyment or leisure, the participation in our Services will be considered a recreational activity under the ACL and this clause will apply to you. By accepting these Terms, you agree that you have read the disclaimer and releases clause above and you are aware that your participation in the Services may be a recreational activity and that it can be inherently dangerous. You agree to release us and any affiliates and all parties associated with organising the Services from any responsibility or legal liability for: (a) death; (b) physical or mental injury (including the aggravation, acceleration or recurrence of such an injury); (c) the contraction, aggravation or acceleration of a disease; (d) the coming into existence, the aggravation, acceleration or recurrence of any other condition, circumstance, occurrence, activity, form of behaviour, course of conduct or state of affairs; a. that is or may be harmful or disadvantageous to you; or b. that may result in harm or disadvantage to you or the community. This release does not apply to significant personal injury caused by our reckless conduct.
