Common use of Recruitment of Positions Clause in Contracts

Recruitment of Positions. The senior applicant for a vacant position, who does not possess the required qualifications for the position, will be considered for the position if they possess the majority of the qualifications (academic and/or experience) which are required and if he/she is currently enrolled in a course of studies which will qualify them for the position. This clause shall not apply when certificates are mandatory for placement in the vacant position. Such an employee will be given a probationary period of four (4) months in the new job, unless otherwise mutually agreed, and the employee will be returned to his/her former position by the College if the required qualifications or certifications are not achieved within the time limits.
