Reference to and Effect on the Purchase Agreement. 4.1 Upon the effectiveness of this Amendment, each reference in the Purchase Agreement to “this Agreement,” “hereunder,” “hereof,” “herein,” “hereby” or words of like import shall mean and be a reference to the Purchase Agreement as amended hereby, and each reference to the Purchase Agreement in any other document, instrument or agreement executed and/or delivered in connection with the Purchase Agreement shall mean and be a reference to the Purchase Agreement as amended hereby.
Reference to and Effect on the Purchase Agreement. On and after this date, each reference in the Purchase Agreement to "this Agreement" and each reference to the Purchase Agreement in the Ancillary Agreements and any and all other agreements, documents and instruments delivered by the Vendor, the Purchaser or any other Person shall mean and be a reference to the Purchase Agreement as amended by this amending agreement. Except as specifically amended by this amending agreement, the Purchase Agreement shall remain in full force and effect and is hereby ratified and confirmed.

From and after the effective date hereof, each reference in the Purchase Agreement to “this Agreement,” “hereunder,” “hereof” or words of like import referring to the Purchase Agreement, and each reference in any other Transaction Documents to the “Securities Purchase Agreement,” “thereunder,” “thereof” or words of like import referring to the Purchase Agreement, shall mean and be a reference to the Purchase Agreement as amended hereby. Except as specifically provided herein, the Purchase Agreement and the other Transaction Documents shall remain in full force and effect. Except as specifically provided above, the execution, delivery and effectiveness of this Amendment Agreement shall not operate as a waiver of any right, power or remedy of the Company or Buyer under the Purchase Agreement or any of the Transaction Documents.
Reference to and Effect on the Purchase Agreement. This Amendment is an amendment to the Original Agreement and, pursuant to Section 13.9 of the Original Agreement, shall be effective and binding upon all parties to the Original Agreement upon the execution of this Amendment by each of the undersigned. It is the express intention of the parties hereto that this Amendment shall not, and shall not be interpreted to, expand or reduce the rights of any party to the Original Agreement except as and solely to the extent expressly provided herein. Except as expressly provided by this Amendment, the Original Agreement shall continue and remain in full force and effect in accordance with its terms. All references to the Purchase Agreement shall hereafter mean the Purchase Agreement as amended by this Amendment, and references in the Agreement to the “date hereof” or the “date of this Agreement” shall be deemed to refer to the original date of the Agreement.
