References and Defined Terms. Unless otherwise expressly indicated herein, references in this Agreement or in Exhibit A (Defined Terms) to an Exhibit or Section refer to the appropriate Exhibit or Section in this Agreement. For the purposes of this Agreement, references to “Customer”, “customer employees” and “customer personnel” shall include employees of Customer’s Affiliates and any employee of Customer or its Affiliates hired through a staffing agency or other contract employee provider and treated as an employee of Customer or its Affiliates and for whose actions Customer or its Affiliates shall be legally responsible.
References and Defined Terms. All references in the Original Agreement to “the Merger Agreement,” “this Agreement,” “herein,” “hereof,” “hereby,” or “hereunder” shall be deemed to be references to the Original Agreement, as amended by this Amendment. Notwithstanding anything to the contrary in this Paragraph 1, all references in the Original Agreement to “the date of this Agreement” or “the date hereof” shall be deemed to be references to February 28, 2005; provided that the reference in Section 4.21 of the Original Agreement shall be deemed to refer to the date of this Amendment. All terms used herein that are defined in the Original Agreement have the meanings set forth therein.
