Common use of References to the Operator Clause in Contracts

References to the Operator. All references in this Agreement to an act, omission, right or obligation of an Operator are to be interpreted as an act, omission, right or obligation (as applicable) of that Operator in the course of providing Train Services for the End User in respect of the Access Rights, and not in connection with: (a) the provision of Train services by the Operator for any other person; or (b) the provision of Train services for the End User in respect of access rights granted under any other Access Agreement.

References to the Operator. All references in this Agreement to an act, omission, right or obligation of an Operator are to be interpreted as an act, omission, right or obligation (as applicable) of that Operator in the course of providing Train Services for on behalf of the End User in respect of the Access Rights, and not in connection with: (a) the provision of Train train services by for or on behalf of the Operator for or any other person; or (b) the provision of Train train services for or on behalf of the End User in respect of access rights granted under any other Access Agreement.

References to the Operator. All references in this Agreement to an act, omission, failure to act, right or obligation of an Operator are is to be interpreted construed as an act, omission, failure to act, right or obligation (as applicable) of that Operator in the course of providing Train Services for or on behalf of the End User in respect of the Access RightsRights granted under this Agreement, and not in connection with: (a) the provision of Train services by the Operator Services for any other person; or (b) the provision of Train services Services for the End User in respect of access rights granted under any other Access Agreementagreement.
