Return of Security. Provided that no Default or Event of Default has occurred and is continuing, the balance of the Security (if any) shall be returned to Lessee within ***** after full and final performance by Lessee of all of its obligations under all of the Lessee’s Documents.
Return of Security. The Security is a part of the consideration for execution of this Lease. If Lessee shall have fully performed all terms and conditions of this Lease, any cash deposit security shall be paid to Lessee within thirty (30) days following the termination (or expiration) date without interest; otherwise the Port shall, in addition to any and all other rights and remedies available under this Lease or at law or equity, retain title thereto.
Return of Security. Aurizon Network must return to the Access Holder (and, where appropriate, give the Access Holder any necessary releases in relation to) any Security provided by the Access Holder under this clause 6:
(a) subject to Aurizon Network’s rights of recourse to the Security under clause 6.6, promptly and in any event within 10 Business Days after the date of termination or expiry of this Agreement;
(b) on the Access Holder delivering to Aurizon Network any replacement Security under clause 6.3(b)(iv), 6.4(c)(iv) or 6.5 which satisfies the requirements of this clause 6; or
(c) if, after a review pursuant to clause 6.7, Aurizon Network considers, acting reasonably, that it is no longer necessary for the Access Holder to provide Aurizon Network with Security under this clause 6.
Return of Security. QR Network must repay or return to the Operator (and where appropriate provide to the Operator any necessary releases in relation to) any Security provided by the Operator under Clause 2.4:
(a) subject to QR Network’s rights of recourse to the Security in Clause 2.5, promptly after the Termination Date;
(b) on receipt of an additional or replacement Security provided by the Operator in accordance with Clause 2.4(c) or 2.4(f); or
(c) following a review pursuant to Clause 2.4(g), QR Network, acting reasonably, finds that it is not necessary for the Operator to provide QR Network with a Security.
Return of Security. Aurizon Network must return to the End User (and, where appropriate, give the End User any necessary releases in relation to) any Security provided by the End User under this clause 6:
(a) subject to Aurizon Network’s rights of recourse to the Security under clause 6.6, promptly after the date of termination or expiry of this Agreement;
(b) on the End User delivering to Aurizon Network any replacement Security under clause 6.3(b)(iv), 6.4(e) or 6.5 which satisfies the requirements of this clause 6; or
(c) if, after a review pursuant to clause 6.7, Aurizon Network considers, acting reasonably, that it is no longer necessary for the End User to provide Aurizon Network with Security under this clause 6.
Return of Security. Aurizon Network must repay or return to the End User (and where appropriate provide to the End User any necessary releases in relation to) any Security provided by the End User under Clause 3.4:
(a) subject to Aurizon Network’s rights of recourse to the Security in Clause 3.5, promptly after the Termination Date;
(b) on receipt of an additional or replacement Security provided by the End User in accordance with Clause 3.4(c) or 3.4(f); or
(c) following a review pursuant to Clause 3.4(g), Aurizon Network, acting reasonably, finds that it is not necessary for the End User to provide Aurizon Network with a Security.
Return of Security. Subject to Clause 3.7(c) of the End User Access Agreement, Aurizon Network must repay or return to the Operator (and where appropriate provide to the Operator any necessary releases in relation to) any Security provided by the Operator under Clause 2.4:
(a) subject to Aurizon Network’s rights of recourse to the Security in Clause 2.5, promptly after the Termination Date;
(b) on receipt of an additional or replacement Security provided by the Operator in accordance with Clause 2.4(c) or 2.4(f); or
(c) following a review pursuant to Clause 2.4(g), Aurizon Network, acting reasonably, finds that it is not necessary for the Operator to provide Aurizon Network with a Security.
Return of Security. When the Obligations have been paid in full, Agent shall promptly deliver the certificates representing the Shares then held by it and all related stock powers to Pledgor.
Return of Security. The Letter of Credit and/or any remaining portion of any Cash Security then held by Owner for the performance of Tenant's obligations under this Lease as security shall be returned to Tenant after (i) the Expiration Date and (ii) the full observance and performance by Tenant of all of the terms, covenants and conditions of this Lease on Tenant's part to be observed and performed, including, but not limited to, the provisions of Article 21.
Return of Security. The Security is a part of the consideration for execution of this Agreement. If Concessionaire shall have fully performed all terms and conditions of this Agreement, any cash deposit security shall be paid to Concessionaire within sixty (60) days following the termination (or expiration) date without interest; otherwise the Port shall, in addition to any and all other rights and remedies available under this Agreement or at law or equity, retain title thereto.
