Common use of Referral to Minister Clause in Contracts

Referral to Minister. The Minister shall consult with the CEO and the Chairperson of the PBC as to how the dispute ought to be determined. The Minister may then decide how the dispute will be determined, or decide the dispute himself. The Minister is not required to act on any advice or recommendation made by the CEO, or the Chairperson of the PBC and the determination of the dispute shall be treated as a decision of the JMB. (a) If the Dispute is referred to the Minister for a decision, the Minister shall consult with the CEO and the Chairperson of the PBC regarding how it ought to be determined and may then either decide how the Dispute should be determined or decide the Dispute. (b) For the avoidance of doubt, the Minister is not required to act in accordance with any advice from, or recommendation made by, the CEO or the Chairperson of the PBC in the course of the consultation process. (c) A determination of the Dispute by the Minister under this clause shall be deemed to be a decision of the Joint Management Body.
