Reformulation Commitment. As of the Effective Date, Xxx X’Xxxx shall not manufacture, import, distribute, sell or offer the Products for sale in the State of California unless they are Reformulated Products pursuant to Section 2.1 above or carry the Proposition 65 warnings specified in Section 2.3 below.
Reformulation Commitment. As of the Effective Date all Products manufactured, imported, distributed, sold, and/or offered for sale in the State of California by, or on behalf of, Gekkeikan via SFI or otherwise shall be Products that qualify as Reformulated Products as defined in Section 2.1 above.
Reformulation Commitment. As of the Effective Date, Kikkerland shall not manufacture, import, distribute, sell or offer the Products for sale in the State of California unless they are Reformulated Products pursuant to Section 2.1.
Reformulation Commitment. As of the Effective Date, Boss shall not manufacture, import, distribute, sell or offer the Products for sale in the State of California unless they are Reformulated Products pursuant to Section 2.1 above, or Products containing appropriate Proposition 65 warnings as described in Section 2.3 below.
Reformulation Commitment. As of the Effective Date, Homestead shall not manufacture, import, distribute, sell or offer the Products for sale in the State of California unless they are Reformulated Products pursuant to Section 2.1 above, or shall carry the Proposition 65 warnings specified in Section 2.3 below.
Reformulation Commitment. Commencing on the Effective Date and continuing thereafter, all Products Suddora manufactures, imports, sells, ships, or distributes for sale in or into California, directly or through one or more third party retailers or e-commerce marketplaces, shall meet the Reformulation Standard for Reformulated Products, as defined by Section 2.2.
Reformulation Commitment. Commencing on the Effective Date and continuing thereafter, 99 Cents agrees to only manufacture for sale or purchase for sale in California, “Reformulated Products”. For purposes of this Settlement Agreement, “Reformulated Products” are Products that:
(a) contain no more than to 90 parts per million (“ppm”) lead when analyzed pursuant to U.S. Environmental Protection Agency testing methodologies 3050B and 6010B or equivalent methodologies utilized by federal or state agencies for the purpose of determining lead content in a solid substance; and (b) yield no more than 1.0 microgram (“ug”) of lead when a wipe is applied to all surfaces according to NIOSH Test Method No. 9100.
Reformulation Commitment. On or before May 30, 2016, and continuing thereafter, 3N Optical agrees to only purchase for sale or distribution in or into California, “Reformulated Products” as defined herein. For purposes of this Amended Settlement Agreement, “Reformulated Products” are Products that do not contain DEHP in concentrations greater than 0.1 percent by weight (1,000 parts per million) when analyzed pursuant to U.S. Environmental Protection Agency testing methodologies 3580A and 8270C or other methodology utilized by federal or state government agencies for the purpose of determining DEHP content in a solid substance. To comply with this reformulation commitment in the particular circumstances of this matter, 3N Optical shall send a written specification to its vendors, requiring them to supply only Products meeting the definition of “Reformulated Products” to 3N Optical.
Reformulation Commitment. As of the Effective Date, Ascent shall not manufacture, import, distribute, sell or offer the Products for sale in the State of California unless they are Reformulated Products pursuant to Section 2.1.
Reformulation Commitment. Commencing on the Effective Date and continuing thereafter, all Products Amazing Shine manufactures, imports, sells, ships, or distributes for sale in or into California, directly or through one or more third party retailers or e-commerce marketplaces, shall meet the Reformulation Standard for Reformulated Products, as defined by Section 2.2.
