Common use of Refunds; Violation Clause in Contracts

Refunds; Violation. (a) If any MCC Funding, any interest or earnings thereon, or any Program Asset is used for any purpose in violation of the terms of this Compact, then MCC may require the Government to repay to MCC in United States Dollars the value of the misused MCC Funding, interest, earnings, or asset, plus interest within thirty (30) days after the Government’s receipt of MCC’s request for repayment. The Government will not use MCC Funding, proceeds thereof or Program Assets to make such payment.

The Government will not shall use national funds (and no MCC Funding, proceeds thereof Funding or Program Assets assets) to make such payment.
