Common use of Regional Detention Facilities Clause in Contracts

Regional Detention Facilities. The Parties acknowledge that the Xxxxxx Creek and Tyee Regional Detention Facilities are owned and operated by the Port. The Port agrees that it will maintain and operate these Facilities in accordance with the design and operating standards established by King County for the shared benefit of all jurisdictions whose storm water drains to those facilities. The Port agrees to consult with these neighboring jurisdictions before undertaking any alterations to the facility. Any alterations that increase or reduce benefit or use to neighboring jurisdictions shall result in a proportionate adjustment in the Storm Water Fee Credit given to the Port.
