Common use of Registering for the Service Clause in Contracts

Registering for the Service. 4.1. By opting into the Service, you confirm that you are least eighteen (18) years old and a registered and active M-PESA Subscriber for at least six (6) months immediately preceding the date of your application to register for the Service. We reserve the right to verify the authenticity and status of your M-PESA Account and transactions and may decline your application if we are not satisfied that you have met these minimum requirements. 4.2. You may register for the Service on more than one MSISDN provided that these terms and conditions will apply to each M-PESA Account that may be registered in your name. 4.3. Safaricom and NCBA may exchange any of your Personal Information held by them in respect of provision of any Safaricom or NCBA products and services including the M-PESA Service. Such Personal Information includes but is not restricted to your phone number, name, date of birth, ID or Passport Number and such other information that will enable us to identify you and comply with the regulatory “know your customer” requirements. 4.4. You also hereby agree and authorize us to use information relating to your use of the M-PESA service, M-Shwari Service, M-PESA System and other Safaricom products as we shall require for purposes of delivering the Services (“M-PESA Information”). 4.5. You may opt in to the Service solely by way of an electronic application made by you using your Equipment via the USSD or Safaricom App. 4.6. You hereby agree and authorize us to obtain and procure your Personal Information from the Government of Kenya’s repositories which, includes but is not limited to IPRS and you further agree and consent to the disclosure and provision of such Personal Information by the Government of Kenya to us. 4.7. You hereby further acknowledge and authorize us to verify your Personal Information in our custody against the information received from the Government of Kenya repositories (including but not limited to IPRS) in your respect. 4.8. We reserve the right to request further information from you pertaining to your application to register for the Service at any time. Failure to provide such information within the time we require may result in a decline of your application to register for the Service. 4.9. Our acceptance or decline of your application to register for the Service shall be communicated through an SMS sent to your Safaricom registered mobile phone number (MSISDN) associated with your M-PESA account and or Equipment. You acknowledge and accept that our acceptance of your application to register for the Service creates a separate and distinct contractual relationship between you and Safaricom outside the terms and conditions that apply to your M- PESA Account from time to time. 4.10. We reserve the right to decline your application to register for the Service or, subject to 30 days’ notice or such other notice as may be required by law, to revoke your registration on the Service. Where we decline your application to register or revoke your registration we shall endeavor to formally communicate to you our reasons for the same.

You also hereby agree and authorize us to use information relating to your use of the M-PESA service, KCB M-PESA Service, M-Shwari Service, M-PESA System and other Safaricom products as we shall require for purposes of delivering the Services (“M-PESA Information”). 4.5. You may opt in to the Service solely by way of an electronic application made by you using your Equipment via the USSD or Safaricom App. 4.6. You hereby agree and authorize us to obtain and procure your Personal Information contained in the IPRS from the Government of Kenya’s repositories which, includes but is not limited to IPRS Kenya and you further agree and consent to the disclosure and provision of such Personal Information by the Government of Kenya to us. 4.7. You hereby further acknowledge and authorize us to verify your Personal Information in our custody against the information received from the Government of Kenya repositories (including but not limited to IPRS) in your respectrespect as contained in the IPRS. 4.8. We reserve the right to request further information from you pertaining to your application to register for the Service at any time. Failure to provide such information within the time we require may result in a decline of your application to register for the Service. 4.9. Our acceptance or decline of your application to register for the Service shall be communicated through an SMS sent to your Safaricom registered mobile phone number (MSISDN) associated with your M-PESA account and or Equipment. You acknowledge and accept that our acceptance of your application to register for the Service creates a separate and distinct contractual relationship between you and Safaricom outside the terms and conditions that apply to your M- PESA Account from time to time. 4.10. We reserve the right to decline your application to register for the Service or, subject to 30 days’ notice or such other notice as may be required by law, to revoke your registration on the Service. Where we decline your application to register or revoke your registration we shall endeavor to formally communicate to you our reasons for the same.

You hereby agree and authorize us to exchange between Safaricom and NCBA may exchange CBA any of your Personal Information personal information held by them us in respect of provision of any Safaricom or NCBA CBA products and services including the M-PESA Service. Such Personal Information personal information includes but is not restricted to your phone number, name, date of birth, ID or Passport Number and such other information that will enable us to identify you and comply with the regulatory “know your customer” requirementsrequirements (together the “Personal Information”). 4.4. You also hereby agree and authorize us to use information relating to your use of the M-PESA service, M-Shwari Service, M-PESA System and other Safaricom products as we shall require for purposes of delivering the Services (“M-PESA Information”). 4.5. You must be at least eighteen (18) years old and old, have a registered and active M-PESA Subscriber Account for at least six (6) months immediately preceding the date of your application to register for the ServiceService and must have be 30-day active for a period of 3 months to be eligible for the service. We reserve the right to verify the authenticity and status of your M-PESA Account and transactions and may decline your application if we are not satisfied that you have met these minimum requirements. 4.2. You may register for the Service on more than one MSISDN M-PESA Account provided that clause 2.11 and all of these terms and conditions will apply to each M-M- PESA Account that may be registered in your name. 4.3. Safaricom You hereby agree and NCBA may authorize us to exchange between Safaricom, KCB, our Bank partners any of your Personal Information Customer information held by them us in respect of provision of any Safaricom or NCBA products and services including the M-PESA Service. Such Personal Information personal information includes but is not restricted to your phone number, name, date of birth, ID or Passport Number KYC and such other information that will enable us to identify you and comply with the regulatory “know your customer” requirementsrequirements (together the “Customer Information”). 4.4. You also hereby agree and authorize us to use information relating to your use of the M-PESA service, KCB M-Shwari PESA Service, M-PESA System and other Safaricom products as we shall require for purposes of delivering the Services (“M-PESA Information”). 4.5. You may opt in to into the Service solely by way of an electronic application made by you using your Equipment via the USSD or Safaricom M-PESA Business App. 4.6. We reserve the right to request further information from you pertaining to your application to register for the Service at any time. Failure to provide such information within the time we require may result in a decline of your application to register for the Service. 4.7. You hereby agree and authorize us to obtain and procure your Personal Information from the Government of Kenya’s repositories which, includes but is not limited to IPRS and you further agree and consent to the disclosure and provision of such Personal Information by the Government of Kenya to us. 4.74.8. You hereby further acknowledge and authorize us to verify your Personal Information in our custody against the information received from the Government of Kenya repositories (including but not limited to IPRS) in your respect. 4.84.9. You hereby expressly consent and authorize us to disclose, receive, record or utilize your Personal Information or information or data relating to your account with respect to the Service and any details on your use of the KCB M-PESA and Fuliza services for the purposes of this Service and other services as we shall advise you between the KCB and Safaricom for the purposes of this Service and other services as we shall advise you. 4.10. We reserve the right to request further information from you pertaining to your application to register for the Service at any time. Failure to provide such information within the time we require may result in a decline of your application to register for the Service. 4.94.11. Our acceptance or decline of your application to register for the Service shall be communicated through an SMS sent to your Safaricom registered mobile phone number (MSISDN) associated with your M-PESA account and or EquipmentCustomer Nominated Number contact details provided by you. You acknowledge and accept that our acceptance of your application to register for the Service creates a separate and distinct additional contractual relationship between you and Safaricom outside the terms and conditions that apply to your you for the use of other M- PESA Account products from time to time. 4.104.12. We reserve In the right event a Transacting Till(s) associated to decline your application a nominated number is swapped, or the nominated number is swapped or recycled, You shall not be able to register for access the Service or, subject to 30 days’ notice or such other notice as may be required by law, to revoke your registration on the Service. Where we decline your application to register or revoke your registration we shall endeavor to formally communicate to you our reasons for the same.a period of twenty- four (24) hours

We reserve the right to verify the authenticity and status of your M-PESA Airtel Money Account and transactions and may decline your application if we are not satisfied that you have met these minimum requirements. 4.2. 4.2 You may register for the Service on more than one MSISDN provided that these terms and conditions will apply to each M-PESA Airtel Money Account that may be registered in your name. 4.3. Safaricom 4.3 You hereby agree and NCBA may authorize us to exchange between Airtel Money and I&M Bank any of your Personal Information personal information held by them us in respect of provision of any Safaricom Airtel Money or NCBA I&M Bank products and services including the M-PESA Airtel Money Service. Such Personal Information personal information includes but is not restricted to your phone number, name, date of birth, ID or Passport Number and such other information that will enable us to identify you and comply with the regulatory “know your customer” requirementsrequirements (together the “Personal Information”). 4.4. 4.4 You also hereby agree and authorize us to use information relating to your use of the M-PESA Airtel Money service, M-Shwari ServiceAirtel Money System, M-PESA System and other Safaricom Airtel Money products as we shall require for purposes of delivering the Services (“M-PESA Information”)Services. 4.5. 4.5 You hereby agree and authorize us to contact you for various loan services including loan recovery and surveys through different channels including SMS, OBD (Out Bound Dialer), IVR (Interactive Voice Response) and calls through our recovery agents. 4.6 You may opt in to into the Service solely by way of an electronic application made by you using your Equipment via the USSD or Safaricom Appany other channel which may be added in future. 4.6. 4.7 You hereby agree and authorize us to obtain and procure your Personal Information from contained in the Government of Kenya’s repositories which, includes but is not limited to IPRS NIDA System and you further agree and consent to the disclosure and provision of such Personal Information by the Government of Kenya Tanzania to us. 4.7. 4.8 You hereby further acknowledge and authorize us to verify your Personal Information in our custody against the information received from the Government of Kenya repositories (including but not limited to IPRS) Tanzania in your respectrespect as contained in the NIDA. 4.8. 4.9 We reserve the right to request further information from you pertaining to your application to register for the Service at any time. Failure to provide such information within the time we require may result in a decline of your application to register for the Service. 4.9. 4.10 Our acceptance or decline of your application to register for the Service shall be communicated through an SMS sent to your Safaricom Airtel registered mobile phone number (MSISDN) associated with your M-PESA Airtel Money account and or Equipment. You acknowledge and accept that our acceptance of your application to register for the Service creates a separate and distinct contractual relationship between you and Safaricom Airtel Money outside the terms and conditions that apply to your M- PESA Airtel Money Account from time to time. 4.10. 4.11 We reserve the right to decline your application to register for the Service or, subject to 30 15 days’ notice or such other notice as may be required by law, to revoke your registration on the Service. Where we decline your application to register or revoke your registration registration, we shall endeavor to formally communicate to you our reasons for the same.
