Common use of Regulatory Authorizations Clause in Contracts

Regulatory Authorizations. (a) The Companies and the XXXX Supplier shall obtain and maintain throughout the Delivery Period all regulatory authorizations necessary to perform their respective obligations under this Agreement, and with respect to the XXXX Supplier only, the XXXX Supplier shall have and maintain, throughout the Delivery Period, FERC authorization to make sales of Energy, Capacity, and Ancillary Services at market-based rates within PJM. (b) The XXXX Supplier shall cooperate in good faith with the Companies in any regulatory compliance efforts as may be required to maintain the ongoing legitimacy and enforceability of the terms of this Agreement and to fulfill any regulatory reporting requirement associated with the provision of XXXX Supply before the PUCO, FERC or any other Governmental Authority.
